b. Authorize the Director of Public Works, or his designee, to act as the agent for the County to execute documents to secure these funds from Transportation Agency for Monterey County.

RECOMMENDATION:
It is recommended that the Board of Supervisors adopt a Resolution to:
 
a. Approve a Local Agency Funding Allocation Agreement between the Transportation Agency for Monterey County and the County of Monterey for the Allocation of Funding Approved by the Transportation Agency for Monterey County Board of Directors for County projects; and
 
b. Authorize the Director of Public Works, or his designee, to act as the agent for the County to execute documents to secure these funds from Transportation Agency for Monterey County.
 
SUMMARY:
On May 20, 2014 the Board of Supervisors approved a Master Agreement between the Transportation Agency for Monterey County (TAMC) and the County of Monterey (County) for Regional Surface Transportation Program (RSTP) funds for County projects along with a list of earmarked projects receiving RSTP funds (Master Agreement).  TAMC has since revised the Master Agreement, now termed a Local Agency Funding Allocation Agreement, to include all funding sources they administer, including RSTP, Transportation for Livable Communities (RSTP-TLC), RSTP Fair Share, Transportation Development Act (TDA) 2%, and Regional Development Impact Fees (RDIF).
 
DISCUSSION:
The Master Agreement was designed to comply with state requirements that TAMC has entered into agreements with member agencies for reimbursement of RSTP funds only.  The State worked with TAMC and other recipients of State and Federal Pass Through funds to solicit their comments and incorporate wherever possible their suggestions into a new agreement (Local Agency Funding Allocation Agreement between the Transportation Agency for Monterey County and the County of Monterey for the Allocation of Funding Approved by the Transportation Agency for Monterey County Board of Directors Agreement) that covers all sources of discretionary funding that passes through TAMC.
 
On September 24, 2014, the TAMC Board approved the Local Agency Funding Allocation Agreement (Agreement) which replaced the Master Agreement to include all sources of discretionary funding administered by TAMC.  The Agreement will need to be executed prior to the County requesting reimbursement of discretionary funds from TAMC.  Exhibit A of this Agreement is a list of County projects that have been allocated discretionary funding from TAMC.
 
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel has reviewed the Agreement as to form.  Due to the late submission of this Board Report, the CAO Budget and Analysis Division was not provided adequate time to fully review for potential fiscal, organizational policy, or other implications to the County of Monterey.
 
FINANCING:
There is no impact to the General Fund.  TAMC discretionary grant funds do not require a local match.  The anticipated TAMC Discretionary Grant Funds have been included in the FY 2014-15 Adopted Budget for Fund 002, Road Fund.
