RECOMMENDATION:

It is recommended the Board of Supervisors:

a. Award a contract to Monterey Peninsula Engineering, the lowest responsible bidder for the Pavement Improvements at County Service Area (CSA) No. 25, Project No. 812530 in the total amount of $1,722,695.

b. Approve Performance and Payment Bonds executed and provided by Monterey Peninsula Engineering.

c. Authorize a contingency, not to exceed ten percent (10%) of the contract amount or $172,270, to provide funding for approved contract change orders for the Pavement Improvements at County Service Area (CSA) No. 25, Project No. 812530.

d. Authorize the Director of Public Works, Facilities and Parks to execute the contracts and, subject to the provisions of the Public Contract Code and Board Policies as applicable, approve change orders to the contract that do not exceed ten percent (10%) of the original contract amount and do not significantly change the scope of work; and

e. Authorize the Director of Public Works, Facilities and Parks to execute a Certificate of Completion and record a Notice of Completion with the County Recorder when the Director determines that the contract is complete in all respects in accordance with the Plans and Special Provisions for the construction of Pavement Improvements at County Service Area (CSA) No. 25, Project No. 812530.

 

SUMMARY/DISCUSSION:

The Project is within County Service Area (CSA) No. 25 which is accessed from Carmel Valley Road (G-16) at Valley Greens Drive, approximately 3.4 miles east of State Highway 1 (Attachment A).  It consists of paving approximately 13,500 linear feet of two-lane roads within the CSA, slurry sealing shoulders, and improving drainage conditions in cul-de-sac.  Paving will consist of performing a 2.5-inch grind followed by a hot mix asphalt overlay and dig-outs in areas of subgrade failure. 

 

On July 25, 2023, the Board of Supervisors adopted the Plans and Special Provisions for the Pavement Improvements at County Service Area (CSA) No. 25 project.  The project was subsequently advertised, and bids were received and opened on August 10, 2023.  Five (5) bids were received for each project.  The lowest responsible, responsive bidder for Pavement Improvements at County Service Area (CSA) No. 25, Project No. 812530 was Monterey Peninsula Engineering in the amount of $1,722,695, which is approximately 15 percent under the Engineer’s Estimate of $2,020,275.  The second lowest bidder was Coastal Pavement & Excavation, Inc. in the amount of $1,804,805.  A construction contract between the County of Monterey and Monterey Peninsula Engineering Contract, Bonds and Insurance Certificate is included as Attachment B.  A bid summary is included as Attachment C. Construction is anticipated to begin in October 2023. 

 

In accordance with the California Environmental Quality Act (CEQA), Public Works, Facilities, and Parks Department (PWFP) filed a Notice of Exemption on July 7, 2023.  The project has been determined to be categorically exempt per California Code of Regulations (CCR) Section 15301 Existing Facilities.

 

OTHER AGENCY INVOLVEMENT:

The Office of the County Counsel and Contracts/Purchasing attended the August 10, 2023, bid opening and reviewed the bids for conformance with applicable regulations.  The Office of the County Counsel-Risk Management, and Auditor-Controller’s Office have reviewed and approved the contracts and bonds as to form, insurance and indemnification, and fiscal provisions, respectively.

 

FINANCING:

The total estimated project cost for the Pavement Improvements at County Service Area (CSA) No. 25 project, including engineering, construction management, and construction is approximately $3.2 million.  This amount also includes approximately $440,000 in curb, gutter and sidewalk repairs performed by Granite Construction Company under a Job Order Contract (aka JOC) last spring.  A project budget summary is included as Attachment D.

 

This project is included in the Road Fund Fiscal Year 2023-24 Work Plan and will be funded through Measure X funds.  There are sufficient appropriations adopted in the FY 2023-24 Road Fund 002, Appropriation Unit PFP004 budget to finance the construction phase of the project.
