RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve a Memorandum of Understanding (MOU) between the County of Monterey and the City of Greenfield regarding installation and use of flock safety cameras by the City within the County’s right of way”; and
b. Authorize the Director of Public Works, Facilities, and Parks to execute the Memorandum of Understanding.
SUMMARY/DISCUSSION:
The City of Greenfield (City) seeks a cooperative agreement with the County of Monterey (County), collectively referred as to the “parties”, to allow for installation of Flock Safety Cameras within the County right of way to assist law enforcement with emergency response and investigation activities. The City has contracted with Flock Group Inc. (aka Flock Safety) to lease Flock Cameras to install and maintain certain cameras within the County right of way.
The parties have collectively drafted a Memorandum of Understanding (Attachment A). On April 8, 2025, the Greenfield City Council adopted a resolution (RES 2025-22) approving the draft MOU.
Under the proposed MOU, the City would assume all responsibility for the ongoing maintenance of the Flock Safety Cameras within the County right of way. Other than review and issuance of an Encroachment Permit, the County will not have any obligations or responsibilities related to the cameras.
Flock Safety is currently processing an Encroachment Permit with the County (File No. 25EP0052) to install the cameras and related appurtenances at two locations within the County right of way. Under section 2B of the draft MOU, locations set forth in “Exhibit A” of the MOU may be added or modified by written agreement of the “parties” without formal amendment of the MOU. This would allow County staff to process additional camera locations with a standard Encroachment Permit application.
Additionally, the MOU includes an indemnification provision, whereby the City agrees to indemnify, defend, and hold County harmless from and against any damage or liability, costs, or expenses from any third-party claim (including reasonable attorneys’ fees and court costs) stemming from the MOU, including, but not limited to the installation and operation of the cameras.
Therefore, staff recommends that the Board of Supervisors approve the Memorandum of Understanding between the City of Greenfield and the County of Monterey.
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel has reviewed and approved the Agreement as to form. HCD-Engineering Services coordinated with PWFP staff on the Memorandum of Understanding.
FINANCING:
Staff costs to prepare this report are included in the FY2024-25 Adopted Budget for Housing and Community Development Department (HCD) Appropriation Unit HCD002, Unit 8543. The cost of the Memorandum of Understanding (MOU) processing is funded with applicant fees.
