RECOMMENDATION:
It is recommended that the Board of Supervisors:
 
adopt a Resolution to resolve, determine and order a Zero Property Tax Transfer of County tax funds for the reorganization of the Moss Landing County Sanitation District into the Castroville Community Services District.
 
SUMMARY:
The proposed action supports the transfer of wastewater collection services from the Moss Landing County Sanitation District (MLCSD) to the Castroville Community Services District (CCSD).
 
DISCUSSION:
The MLCSD was formed on August 17, 1976, pursuant to California Health and Safety Code Sections 4700 - 4878.  The Monterey County Board of Supervisors serves as the Ex-Officio Board of Directors.  Staffing for the MLCSD is provided by the Resource Management Agency (RMA) Public Works Department as needed.  MLCSD provides wastewater collection services to the Moss Landing Community.
 
The CCSD was formed on February 15, 2008, pursuant to California Government Code Sections 61000 - 61226.5.  The California Government Code authorizes the CCSD to provide a wide variety of services including collection and disposal of wastewater.  Historically, the CCSD has provided water, street lighting, open space maintenance, recreation, drainage and wastewater collection and transport services to the Castroville Community.  
 
The proposed reorganization would result in the dissolution of the MLCSD and in the consolidation of wastewater collection services currently provided by the MLCSD into the CCSD.  The proposed reorganization would also provide for the transfer of assets from the MLCSD to the CCSD.  All revenues, including property tax subventions currently received by the MLCSD, would be received by the CCSD.  The resolving, determining, and ordering of a Zero Property Tax Transfer would apply to property tax revenue received by the MLCSD.
 
OTHER AGENCY INVOLVEMENT:
The proposed reorganization would require approval by the CCSD Board of Directors and by the Local Agency Formation Commission of Monterey County (LAFCO) Commissioners.  The Budget Committee will consider this action at their regular meeting on January 29, 2014.
 
FINANCING:
The proposed action will not impact the General Fund.  Approximately $75,000 received annually in property tax revenue by the MLCSD will be passed on to the CCSD.
