RECOMMENDATION:
It is recommended that the Board of Supervisors:
a.      Approve and authorize the Director of the Department of Social & Employment Services, or his designee, to sign an agreement with Hartnell College for $687,038 to provide foster care and adoption training and recruitment services to eligible Monterey County local agency employees, and current and prospective caregivers, for the period July 1, 2012 through June 30, 2014, including mutual indemnification (Exhibit H); and
 
b.   Authorize the Director of the Department of Social & Employment Services, or his designee, to sign up to three (3) amendments to this agreement, where the total amendments do not exceed 10% of the original contract amount, and do not significantly change the scope of work.
 
SUMMARY/DISCUSSION:
The Department of Social and Employment Services (DSES), Family and Children's Services (FCS) Division, is the local child welfare agency.  DSES contracts with Hartnell College to provide 1) training for current and prospective foster parents, relative and non-related extended family member caregivers, adoptive parents and local agency employees; and 2) support for foster home recruitment activities.  The Department receives annual Title IV-E federal and state-realignment funds to provide these services.
At the request of Hartnell College, the County's standard indemnification language has been modified to include Mutual Indemnification, and is being brought before the Board for approval. It is recommended that the non-standard Mutual Indemnity be approved in order to preserve an ongoing positive relationship with the current provider, and avoid interruption of services. This agreement was delayed coming forward for Board approval due to delayed determination of funding.
OTHER AGENCY INVOLVEMENT:
County Counsel, the Auditor-Controller and Purchasing have reviewed and approved this agreement, with the exception of the non-standard mutual indemnification language which is being submitted for Board approval.
FINANCING:
The recommended action will allow the Department of Social & Employment Services to provide a total of $687,038 in Title IV-E federal and state realignment funds for foster care training and recruitment activities.   The County's match will be provided by Hartnell College through in-kind services.  Sufficient appropriations and estimated revenues in SOCOO5 are included in the Adopted FY 2012-13 Budget. Approval of this action has no impact on the County General Fund.
