Title: a. RECOMMENDATION:

It is recommended that the County of Monterey Board of Supervisors:

a.  Authorize the Director of Health Services or designee to sign Amendment No. 2 to Agreement with Clinicians Telemed Medical Group, Inc, (CT) for qualified and licensed telehealth physicians, nurse practitioners, physician assistants, and/or clinical social workers, extending the term one (1) additional year for a new term of September 1, 2022, to June 30, 2025, with no changes to the total contract amount of $98,000; and

b.  Approve the recommendation of the Director of Health Services to approve the following non-standard risk provisions to the Business Associate Agreement removing requirement for Cyber liability coverage; and

SUMMARY/DISCUSSION:

The Health Department Clinic Services Bureau (Clinic Services) operates twelve community clinic sites designated as Federally Qualified Health Centers (FQHCs) which provide preventive, primary, and specialty medical care services.

 

CT is locally based in California and has expertise providing telemedicine services to federally qualified health centers, rural health clinics, and other similar health care organizations. CT physicians, physician assistants, nurse practitioners, and licensed clinical social workers will provide medical specialty services through interactive audio, video and/or data communications (telemedicine).  

 

On September 1, 2022, the Board of Supervisors approved an Agreement with Clinicians Telemed Medical Group to provide specialty medical services through September 1, 2023, for an amount not to exceed $98,000. On August 1, 2023, Amendment No. 1 was executed to add an additional telehealth specialty to the scope and extend the term to June 30, 2024. Amendment No. 2 will extend the agreement for one (1) additional year and remove the Cyber Liability Insurance requirement from the new Business Associate Agreement.  The Cyber Liability coverage waiver is being recommended due to CT not hosting any protected health information and being limited to secure, remote access to Clinic Services’ electronic medical record (Epic) when delivering remote telehealth services.

 

This work supports the County of Monterey Health Department 2018-2024 Strategic Plan Goals(s):  Ensure access to culturally and linguistically appropriate customer-friendly, quality health services. It also supports one or more of the ten essential public health services, specifically: 7) Link people to needed personal health services and assure the provision of health care when otherwise unavailable; and 8) Assure competent public and personal health care workforce.

 

OTHER AGENCY INVOLVEMENT:

The Office of County Counsel has approved this Amendment No. 2 as to form and Auditor Controller has approved as to fiscal provision. The Privacy Officer has also reviewed this Amendment as to BAA provisions.

 

FINANCING:

Sufficient funds are available in the FY 2023-2024 Adopted Budget for Clinic Services Bureau, Health Department (4000-HEA007). This Amendment No. 2 is funded by revenues generated from Medi-Cal and Medicare reimbursements. There is no financial impact to the General Fund resulting from approval of this Agreement.
