Approve and authorize the Monterey County Laguna Seca Representative to:
a. Execute two (2) retroactive Agreements with Manuel Rivas Jr., dba TellerEXPRESS, to provide, install, and maintain automated teller machines at WeatherTech Raceway at Laguna Seca Raceway from October 1, 2019 through September 30, 2021 (2019 Agreement) and from October 1, 2021 through December 31, 2023 (2021 Agreement); and
b. Execute up to three (3) future amendments to the 2021 Agreement where the total amendments do not significantly change the scope of work, subject to the review and approval of the Office of County Counsel.

RECOMMENDATION:
Approve and authorize the Monterey County Laguna Seca Representative to:
a. Execute two (2) retroactive Agreements with Manuel Rivas Jr., dba TellerEXPRESS, to provide, install, and maintain automated teller machines at WeatherTech Raceway at Laguna Seca Raceway from October 1, 2019 through September 30, 2021 (2019 Agreement) and from October 1, 2021 through December 31, 2023 (2021 Agreement); and
b. Execute up to three (3) future amendments to the 2021 Agreement where the total amendments do not significantly change the scope of work, subject to the review and approval of the Office of County Counsel.
SUMMARY/DISCUSSION:
Staff requests the Board of Supervisors approve two (2) standard retroactive agreements with Manuel Rivas Jr., dba TellerEXPRESS (Contractor) to continue to provide and maintain four (4) automated teller machines at WeatherTech Raceway Laguna Seca (WRLS). The Contractor’s equipment was in place when A&D Narigi Consulting, LLC (A&D) assumed the management of WRLS. A&D and Public Works, Facilities, & Parks (PWFP) staff were able to locate a partially executed agreement for Contractor services, dated October 1, 2019 to September 30, 2021 (2019 Agreement). County Counsel recommended that the 2019 Agreement should be retroactively approved and executed and a second agreement (2021 Agreement) also be executed for services beyond the 2019 Agreement term through the desired initial end date of December 31, 2023.
Under the 2021 Agreement, the Contractor will pay the County a one dollar ($1.00) transaction commission for each withdrawal transaction. Quarterly commission payments are made to the County accompanied by a transaction report.
OTHER AGENCY INVOLVEMENT:
The Office of County Counsel reviewed and approved the proposed retroactive agreements as to form. Risk Management reviewed and approved the insurance coverage and limits.
FINANCING:
These agreements are revenue generating for Fund 453 Laguna Seca Budget. There is no direct cost to the County as a result of executing the agreements.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
The recommended action supports the Board of Supervisors Strategic Initiative for Economic Development. Use of the services will generate revenue to sustain the park facility and promote economic development by attracting domestic and international visitor dollars that will stimulate the local economy.
