RECOMMENDATION:
It is recommended that the Board of Supervisors:
  1. Approve and authorize the Contracts/Purchasing Officer to sign an Agreement with Community Hospital of the Monterey Peninsula, in an amount not to exceed $257,625, to provide outpatient HIV specialty medical services to individuals living with HIV and AIDS, for the period of July 1, 2013 to March 31, 2017; and
  2. Authorize the Contracts/Purchasing Officer to approve three future amendments up to ten percent (10%) of the annual amount, which does not significantly alter the scope of services or result in an increase to net county costs.
 
SUMMARY/DISCUSSION:
The Monterey County Health Department (MCHD) and Community Hospital of the Monterey Peninsula (CHOMP) through its Outpatient Immunology Services (OPIS) clinic have a long standing professional and collaborative relationship that each party wishes to continue.  The clinic provides outpatient HIV specialty medical services to individuals living with HIV and AIDS.  Clinical services also provided by OPIS include, oral health and mental health services, emergency financial assistance for medications as well as AIDS Drug Assistance Program (ADAP) registration and renewal.
 
MCHD wishes to enter into an agreement with CHOMP for a nine month and three year term beginning July 1, 2013 through March 31, 2017.  The reason for this unusual term is due to the funding source for these services, federal Ryan White Part B program.  The Ryan White program operates on a fiscal year from April 1st through March 31st.  The California Department of Public Health (CDPH) Office of AIDS (OA) is responsible for allocating these funds to Local Health Jurisdictions (LHJ) and as such, is aligning their LHJ contracts with the federal funding source.  To implement this alignment, CDPH OA is executing nine month agreements with LHJs, July 1, 2013 through March 31, 2014, followed by three year agreements, April 1, 2014 through March 31, 2017.  CDPH OA has provided MCHD with an official letter stating their intent to engage in three year agreements beginning April 1, 2014.
 
MCHD would also like to implement this best practice of aligning subcontract agreements with the funding source.  So while we currently only have an agreement, budget and scope of work with CDPH OA for the nine month term, we would like to move forward with executing this agreement for the full, intended term.  Once the budgets and scopes for the three year term become available, they will be agreed upon in writing by both parties, and included into our agreement with CHOMP.  This course of action will ensure these critical services will continue without interruption.
 
OTHER AGENCY INVOLVEMENT:
County Counsel and the Auditor-Controller have reviewed and approved this Agreement as to legal form and fiscal provisions, respectively.  A copy of the Agreement is on file with the Clerk to the Board.
 
FINANCING:
This agreement is fully funded through the federal Ryan White Part B program, administered through the California Department of Public Health, Office of AIDS.
