RECOMMENDATION:
It is recommended that the Board of Supervisors:
  1. Approve and authorize the Contracts/Purchasing Officer to execute an Agreement with County of Alameda to provide housing/bed space for Monterey County inmates in the Santa Rita Jail in an amount of not less than $85 and not more than $125 per day per inmate for a term to commence with the signing of the Agreement through June 30, 2014; and,
  2. Authorize the Contracts/Purchasing Officer to approve up to three future amendments to this Agreement where the amendments do not exceed 10% of the original agreement and do not significantly change the scope of work.
 
SUMMARY/DISCUSSION:
The Sheriff's Office has taken numerous steps to reduce over-crowding in the Monterey County Jail. Despite these efforts the average daily inmate population consistently remains at approximately 130% of the jail's rated capacity of 824 inmates.  With the increase in sentenced inmates serving longer terms in the Monterey County jail as a result of the State Public Safety Realignment (AB 109), the efforts of the department have served mainly to keep the jail population from growing too fast rather than helping to reduce the overcrowding. As a result, the Sheriff's Office proposes to enter into an inmate-housing agreement with the County of Alameda to house up to sixty Monterey County inmates per month in their jail system on an ongoing basis.  
 
The Alameda County Sheriff will provide custody and care for Monterey County inmates pursuant to Minimum Standards for Local Detention Facilities as set forth in California Code of Regulations Titles 15 and 24, and in accordance with all applicable Federal, State and local laws.  The Alameda Sheriff will provide inmates with the same full range of medical care available inside the facility as is provided to Alameda County inmates.  All non-routine and outside medical services will be paid for by Monterey County.  Alameda County agrees to only release inmates to a representative of Monterey County or federal law enforcement designee with a valid removal order.  Once an inmate is set to be released from custody, the inmate will be returned to Monterey County.  Monterey County will retain responsibility for the transportation of inmates to and from Alameda County.
 
The costs for housing the inmates are graduated based upon the number of inmates sent from our county with the lowest rate being $85.00 per inmate per day based upon a minimum of 46 inmates.  On April 25, 2013, the Community Corrections Partnership (CCP) approved the FY 2013-14 budget for the recommended use of AB 109 funds.  This CCP budget includes $2.5 million to fund the provision of additional jail beds to accommodate the increased number of inmates due to realignment.  It is the Sheriff's Office recommendation to use these funds to cover the costs associated with housing inmates in Alameda County under this agreement.  The housing of Monterey County inmates in Alameda County Jail will continue as long as the need exists and AB 109 funds are available.  
 
Senate Bill 1021 signed by the Governor on June 27, 2012, and effective July 1, 2012, allows the Board of Supervisors of a county where adequate corrections facilities are not available to enter into an agreement with the Board of Supervisors of one or more nearby counties (do not have to be contiguous) whose county adult detention facilities are adequate and are readily accessible for jail bed space.
 
The Sheriff's Office will continue to work with its partners to explore other options for addressing over-crowding in the County's adult detention facility.

The County Administrative Office, Auditor-Controller, Contract/Purchasing, Risk Management and County Counsel have been consulted in the preparation of this report.
 
 
FINANCING:
The costs of the agreement will be fully reimbursed by AB 109 funds approved by the CCP for FY 2012-13 and FY 2013-14.
