a. Approve and authorize the Director or the Assistant Director of the Department of Social Services to sign an agreement with IDEMIA Identity & Security USA LLC to provide two mobile Live Scan Systems equipped with the accepted standard California Department of Justice (CAL-DOJ) software and workflows to perform fingerprint scanning, effective March 12, 2024 through March 11, 2027, in the amount of $30,016;
b. Approve the recommendation of the Director of the Department of Social Services to accept all non-standard provisions in the Agreement; and
c. Authorize the Director or the Assistant Director of the Department of Social Services to sign up to three (3) future amendments to this agreement where the total amendments do not exceed 10% ($3,002) of the original contract amount, do not significantly change the scope of work, and do not exceed the maximum aggregate amount of $33,018.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Director or the Assistant Director of the Department of Social Services to sign an agreement with IDEMIA Identity & Security USA LLC to provide two mobile Live Scan Systems equipped with the accepted standard California Department of Justice (CAL-DOJ) software and workflows to perform fingerprint scanning, effective March 12, 2024 through March 11, 2027, in the amount of $30,016;

SUMMARY/DISCUSSION:
This Agreement provides new equipment and maintenance to upgrade the existing IDEMIA Live Scan product used by the Monterey County Department of Social Services (DSS) to meet System Security requirements and continue to conduct fingerprint imaging for background checks. DSS conducts fingerprint imaging background checks on potential new hires (pre-hire) and potential resource families before a child is placed in their care. The fingerprint images are used to conduct a background check against a Department of Justice (DOJ) criminal database. The Agreement is inclusive of IDEMIA’s terms and conditions, requiring board Approval.
The Agreement includes the purchase of two mobile Live Scan Systems equipped with the accepted standard California Department of Justice (CAL-DOJ) software and workflows, printer, scanner which will be located at the Life Foundation Human Resources and 713 La Guardia Family and Children Services location. Additionally, the Agreement provides three years of technical support for the IDEMIA Live Scan Systems, Technical Support for problem escalation, and parts and components necessary for the service and maintenance of the system.
OTHER AGENCY INVOLVEMENT:
Auditor-Controller’s Office reviewed the contract but does not agree to the non-standard payment provisions. County Counsel has approved the agreement as to form. Contracts/Purchasing cannot approve the nonstandard agreement.
FINANCING:
This Agreement will be funded by Social Services Federal, State and Sales Tax realignment funds. Sufficient appropriations and estimated revenues for 001-5010-SOC005 are included in the FY 2023-24 Adopted Budget.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
This agreement correlates to the Strategic Initiatives adopted by the Board of Supervisors by allowing the Department to improve the quality of life for Monterey County families by expanding the Department’s ability to protect the youths placed with caregivers and the employees they hire.
