b. Authorize the Auditor-Controller to make payments in accordance with the terms of the Agreement.

RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Authorize the Purchasing Agent, or their designee, to execute agreement not to exceed $270,000 with Advanced Chemical Transport, LLC, to provide agricultural chemical packing, transportation, and disposal services for the period of April 27-June 30, 2027, and;

b. Authorize the Auditor-Controller to make payments in accordance with the terms of the Agreement.

 

SUMMARY/DISCUSSION:
The Agricultural Commissioner requires services for the packaging, transportation, and disposal of agricultural chemicals during public takeback events as well as periodic disposal of materials when required through investigations. Advanced Chemical Transport, LLC, dba ACTenviro, has previously provided similar services for the County of Monterey in general and the Agricultural Commissioner specifically in the past. We are requesting authorization to enter into this agreement, for a total cost of $270,000, to facilitate a multi-county pesticide takeback event for the public to provide a zero-cost way for agricultural chemicals to be disposed of properly as well as departmental needs in an ongoing basis.

 

OTHER AGENCY INVOLVEMENT/COMMITTEE ACTIONS:
The Office of the County Counsel and its Risk Management Division have
approved the proposed Agreement as to form and insurance and indemnification provisions. 

 

FINANCING:
The funds are contained in the Agricultural Commissioner’s Budget for FY 2025-2026.  There are no changes to appropriations.  Ongoing funding is subject to availability as determined through the County’s annual Adopted Budget review and approval process. 

 

BOARD OF SUPERVISORS STRATEGIC PLAN GOALS: 
Activities carried out by the ACTenviro under this agreement help maintain Safe and Resilient Communities by removing potentially hazardous materials. Agricultural chemicals that are disposed of properly eliminate the risk of exposure or misuse which provides safety to communities and the public.
