Upon motion of Supervisor Parker, seconded by Supervisor Salinas, and carried by those

members present, the Board hereby:

Introduced, waive the reading, and set f'or August 25, 2009, at 10:30 a.m. to consider adoption of

an ordinance amending the Monterey County Code, Title 12, Section 12.12.010, to establish a 45

m.p.h. speed limit on Laureles Grade from Carmel Valley Road to a point 500 feet north of the

centerline of Miramonte Road, in Carmel Valley.

SUBJECT: Introduce, waive the reading, and set August 25, 2009, at 10:30 a.m. to consider

adoption of an ordinance amending the Monterey County Code, Title 12,

Section 12.12.010, to establish a 45 m.p.h. speed limit on Laureles Grade from

Carmel Valley Road to a point 500 feet north of the centerline of Miramonte

Road, in Carmel Valley.

RECOMMENDATION:

It is recommended that the Board of Supervisors introduce, waive the reading, and set

August 25, 2009, at 10:30 a.m. to consider adoption of an ordinance amending the Monterey

County Code, Title 12, Section 12.12.0 10, to establish a 45 m.p.h. speed limit on Laureles Grade

from Carmel Valley Road to a point 500 feet north of the centerline of Miramonte Road, in

Carmel Valley.

SUMMARY/DISCUSSION:

Several residents that live in the southern area of Laureles Grade near Carmel Valley Road have

requested a posted speed limit of less than 55 m.p.h. to address traffic safety. There is currently

no speed limit signing. The maximum speed limit for Laureles Grade is governed by Section

22349 of the California Vehicle Code which states the maximum speed limit for a two-lane

roadway is 55 m.p.h., and the basic speed law which states you can not drive any faster than

what is prudent and safe for conditions.

The area of concern is one mile in length, has four intersections, several driveways, and carries

approximately 6,300 vehicles per day. Due to trees, dirt embankments and one curve,

intersection sight distance is limited at some of the intersections and driveways.

The Department of Public Works prepared an Engineering and Traffic Survey to determine what

prima facie speed limit could be established and enforced by radar. The survey determined

45 m.p.h. is appropriate and enforceable from Carmel Valley Road to just north of Miramonte

Road, a distance of 0.67 miles. An additional radar survey was taken between Miramonte Road

and one mile north of Carmel Valley Road which supports the existing 55 m.p.h. maximum

speed limit.

OTHER AGENCY INVOLVEMENT:

County Counsel has approved the ordinance as to form. The California Highway Patrol concurs

with this recommendation.

FINANCING:

There is no financial impact to the General Fund. Traffic control devices are paid from the Road

Fund. The cost to install the necessary signing and pavement legends is estimated at $800.

There are sufficient funds available in the Road Fund Fund 002, Unit 8195) to finance this

work.

AN ORDINANCE OF THE COUNTY OF MONTEREY, STATE OF CALIFORNIA,

AMENDING SECTION 12.12.010 OF THE MONTEREY COUNTY CODE RELATING

TO SPEED LIMITS ON COUNTY ROADS.

County Counsel Summary

This ordinance establishes a 45 m.p.h. speed limit on a portion ofLaureles

Grade.

The Board of Supervisors of the County of Monterey ordains as follows:

SECTION 1. Section 12.12.010 of the Monterey County Code is amended by adding to

that section the following street location:

Laureles Grade, from its intersection with Carmel Valley Road northerly to a point 500

feet north of the centerline of Miramonte Road, forty-five miles per hour;

SECTION 2. This ordinance shall become effective on the 31St day following its

adoption.

Expected collision rate on similar State Highways is 1.71 for all collisions

and 0.862 for injury plus fatal.

UNUSUAL CONDITIONS: 8 percent grade and limited sight distance when exiting side roads.

DISCUSSION:

Using the 85th percentile speed alone would set the speed limit at 50 m.p.h. Because of limited corner sight

distance at Los Robles Drive 220 feet looking right & 245 feet looking left) and at Miramonte Road 700 feet

looking right & 460 feet looking left), an 8 percent downgrade for southbound traffic, and a somewhat high

injury plus fatal collision rate, it is recommended the posted limit be reduced an additional 5 mph and be set at

45 m.p.h.

PROPOSED SPEED LIMIT: 45 MPH
