RECOMMENDATION:

It is recommended that the County of Monterey Board of Supervisors:

a. Approve and authorize the Director of Health Services or designee to execute a Services Agreement with University Corporation at Monterey Bay for the County of Monterey to receive funds for the provision of project support to University Corporation at Monterey Bay’s Project REACH, whose mission is to create a culturally responsive, integrated, and multi-tiered system of social emotional services and supports for children in public schools, in the total amount not to exceed $185,000 for a retroactive term of September 25, 2023 through December 31, 2027; and
b. Approve non-standard insurance, limitation of liability, and indemnification provisions to the Services Agreement as recommended by the Director of Health Services; and
c. Approve and authorize the Director of Health Services or designee to execute up to three (3) future amendments to the Services Agreement that do not exceed 10% ($18,500) of the original agreement amount, do not significantly change the scope of services, and do not increase the total not to exceed amount of $203,500.

 

SUMMARY/DISCUSSION:

University Corporation at Monterey Bay is implementing Project REACH, a multi-year grant-funded project focused on creating a culturally responsive, integrated, and multi-tiered system of social emotional services and supports that cultivates mental health and wellness for all students, families, and learning communities across the Monterey County public school system. Project REACH is administering funds to the County of Monterey to participate in the leadership team, advisory council, and professional development.

 

The County will participate in professional development, training, and practice-based activities in collaboration with the Project REACH Leadership Team, including support of professional development workshops for preservice school psychologists and school social workers and the annual summit. Additionally, the County will work in close collaboration with the district teams to facilitate opportunities for learning through leveraging the long-term commitment by all partners in the project.

 

This Services Agreement is being presented late to the Board due to the nonstandard nature of the agreement and insurance and indemnification provisions. Negotiation of the appropriate nature of the agreement terms that were amenable to both the County and to University Corporation at Monterey Bay were lengthy and required input from numerous County and university departments; however, resolution was required in order to produce an agreement that was satisfactory to both parties. The discussions have been resolved and University Corporation at Monterey Bay has provided a signed agreement ready for Board review and approval after a signatory and review period of more than two months. Board approval is being sought immediately after receipt of the Services Agreement. The Health Department additionally requests that the Board accept the Director of Health Services’ recommendation to accept the nonstandard indemnification provisions.

This work supports the following Monterey County Health Department 2018-2024 Strategic Plan Goal: 3. Ensure access to culturally and linguistically appropriate, customer-friendly, quality health services.  It also supports one of the ten essential public health services, specifically: 7. Link people to needed personal health services and assure the provisions of health care when otherwise unavailable.

 

OTHER AGENCY INVOLVEMENT:

The Office of County Counsel and Auditor-Controller have reviewed and approved this Agreement as to legal form and fiscal provisions, respectively. Risk Management has not approved this Contract due to non-standard insurance, limitation of liability, and indemnification provisions.

 

FINANCING:

The total amount for the Services Agreement is $185,000. The associated revenue and costs associated with this Agreement are included in the Health Department's Behavioral Health Bureau (HEA012, Unit 8410) Fiscal Year (FY) 2023-24 Adopted Budget, FY 2024-25 Recommended Budget; for FY 2025-26 through 2027-28, the associated costs and revenue will be included in the Requested Budget.
