RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Authorize the County of Monterey Sheriff or designee to execute a Memorandum of Understanding with any of the Law Enforcement Agency/Department, to offset the costs of providing support to the County of Monterey during a Special Event.

 

SUMMARY/DISCUSSION:

The County of Monterey Sheriff’s Office (MCSO) is requesting authority to execute Memorandums of Understanding (MOU) as necessary for law enforcement support for a Special Event (i.e. Car Week, U.S. Open, etc.).

Currently, we do not have a mechanism in place to allow assistance from other Law Enforcement Agencies (LEA) during special events. Special events are pre-planned and therefore do not qualify as mutual aid requests through the State of California law enforcement mutual aid plan.  By establishing a method for law enforcement support for special events MCSO is pre-positioning itself to have a mechanism in place in event the personnel needs of a special event exceed the capacity of MCSO. 

MCSO will notify participating agencies of their need for law enforcement support and subsequently establish a schedule with the participating agency for the upcoming event. The MOU would allow participating agencies to be reimbursed as a pass-through expense from the revenue generated by the special event at the rate listed on an Exhibit A “Salary for LEA Employee” (Exhibit A will be attached upon signature of agency). 

 

OTHER AGENCY INVOLVEMENT:

County Counsel supports this MOU. The County Administrative Office and Auditor-Controller have reviewed.

 

FINANCING:

There is no impact to the General Fund with this Action. The department budgeted revenue for special events, with actual revenues earned when services are provided. This mechanism will allow for assistance from participating LEAs and a method to pass through any revenue their services generate that the department would not have had the availability to capture.
