Title: a. RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.  Approve Amendment No. 3 to the Memorandum of Understanding (MOU) with the Salinas Valley Solid Waste Authority for the Litter Abatement Program to include reimbursement for disposal fees and to extend the term for two additional years through June 30, 2027, for a revised term from October 8, 2020 to June 30, 2027, with an annual fiscal year funding amount of $125,000 for Fiscal Year (FY) 2025-26 and 2026-27, for a total aggregate amount not to exceed $750,000 and

b.  Authorize the Director of Public Works, Facilities and Parks to execute Amendment No. 3 to the MOU and future amendments where the amendments do not significantly alter the scope of services or increase the approved annual fiscal year funding amount of the MOU.

 

SUMMARY/DISCUSSION:

The County of Monterey Department of Public Works, Facilities and Parks (PWFP) operates a Litter Abatement Program (Program) which provides for the collection and disposal of litter, debris and hazardous materials dumped illegally along County roads and public rights-of-way and on public lands.  The Program removes approximately 400-500 tons of household and industrial materials from County roadways annually.

 

Salinas Valley Solid Waste Authority (SVSWA) provides funds under an established Memorandum of Understanding (MOU) with the County of Monterey for supplemental collection and mitigation efforts by the County using contracted services. The MOU established in Fiscal Year (FY) 2020-21 currently provides $100,000 from SVSWA to support these litter abatement efforts.

 

 

 

 

 

SVSWA is committed to promoting sustainable, environmentally sound, cost-effective practices through systems of waste reduction, reuse, recycling, innovative technology, and education.  PWFP and SVSWA have agreed to extend their respective MOU for an additional two years at the existing annual funding rate per FY to minimize the administrative burden associated with preparing an annual MOU, and to continue litter abatement programs in the County.  Additionally, SVSWA will reimburse the County up to $25,000 for FY 2025-26 and FY 2026-27 and any subsequent FY for disposal (tipping) fees. 

 

OTHER AGENCY INVOLVEMENT:

The Office of the County Counsel and Auditor-Controller’s Office have reviewed and approved Amendment No. 3 to the MOU as to form, and fiscal provisions, respectively.  PWFP’s Program is a planned cooperative effort among the SVSWA, the Monterey Regional Waste Management District dba Regen Monterey (MRWMD), the Monterey County Health Department Environmental Health Bureau (EHB), and third-party contractors.

 

FINANCING:

The FY 2025-26 Recommended Budget for General Fund, Fund 001, Litter Control Appropriation Unit PFP002 includes the assumption that SVSWA would provide $100,000 for the Program.  Under the terms of the MOU, SVSWA will reimburse the County up to 50%, but no more than $100,000 per FY, respectively, for third-party labor costs associated with the Program. In addition, SVSWA will reimburse the County up to an additional $25,000 for disposal (tipping) fees for FY 2025-26 and for each subsequent FY. The County will incur costs and submit invoices to SVSWA for reimbursement per the terms of the MOU. A temporary impact will result to the Road Fund, Fund 002 until reimbursements are received from the SVSWA.

 

PWFP has also budgeted $125,000 in the FY 2025-26 Recommended Budget for the Road Fund, Fund 002, Appropriation Unit PFP004, for Litter Control as part of the County’s ongoing litter abatement efforts.
