a. Approve and authorize the Director of Health Services or designee to execute a retroactive Memorandum of Understanding between the County of Monterey and Primary Diagnostics, Inc. to provide essential data-exchange services to the California Department of Public Health (CDPH), for the term of July 1, 2025 through June 30, 2026 with no exchange in funds;
b. Approve non-standard indemnity and insurance provisions as recommended by the Director of Health Services; and
c. Approve and authorize the Director of Health Services or designee to sign up to three (3) future amendments that do not significantly change the scope of services.

RECOMMENDATION:
It is recommended that the County of Monterey Board of Supervisors:
a. Approve and authorize the Director of Health Services or designee to execute a retroactive Memorandum of Understanding between the County of Monterey and Primary Diagnostics, Inc. to provide essential data-exchange services to the California Department of Public Health (CDPH), for the term of July 1, 2025 through June 30, 2026 with no exchange in funds;
b. Approve non-standard indemnity and insurance provisions as recommended by the Director of Health Services; and
c. Approve and authorize the Director of Health Services or designee to sign up to three (3) future amendments that do not significantly change the scope of services.
SUMMARY:
The County of Monterey Health Department, Public Health Bureau, Public Health Laboratory provides specialized testing services to detect and monitor infectious diseases, identify new and emerging diseases, conduct surveillance testing and serves as a reference laboratory for local hospitals.
DISCUSSION:
The Public Health Laboratory seeks approval to enter into an agreement with Primary Diagnostics, Inc. to maintain connection between the Public Health Laboratory’s laboratory information system (LIS) software and LIS systems with California Department of Public Health Laboratories and other public health laboratories in California to ensure continuity of operations during public health emergencies.
OTHER AGENCY INVOLVEMENT/COMMITTEE ACTIONS:
The offices of the County Counsel and Auditor-Controller have reviewed and approved as to legal form and fiscal provisions.
FINANCING:
There is no exchange of funds with this agreement. There are sufficient appropriations in the Health Department’s (001-4000-8124-HEA003) FY 2025-26 Adopted Budget.
BOARD OF SUPERVISORS STRATEGIC PLAN GOALS:
This Agreement aligns with the Strategic Plan Goal of Safe and Well-Being and Quality of Life, specifically the key objective of Services: Provide service enhancements to support well-being and quality of life. It will allow the Public Health Laboratory to collaborate and securely exchange laboratory data statewide, especially during emergencies.
