a. Approve and authorize the Monterey County Laguna Seca Representative to execute a retroactive Standard Agreement between A & B Fire Protection & Safety, Inc. and the County of Monterey to provide Fire Protection System Inspections and Repairs for WeatherTech® Raceway at Laguna Seca, with a term beginning May 1, 2021 through December 31, 2023, for an amount not to exceed $40,000; and
b. Approve and authorize the Monterey County Laguna Seca Representative to execute up to three (3) future amendments to the Standard Agreement where the total amendments do not exceed ten percent (10%), or $4,000, of the agreement amount and do not significantly change the scope of work, subject to County Counsel approval.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Monterey County Laguna Seca Representative to execute a retroactive Standard Agreement between A & B Fire Protection & Safety, Inc. and the County of Monterey to provide Fire Protection System Inspections and Repairs for WeatherTech® Raceway at Laguna Seca, with a term beginning May 1, 2021 through December 31, 2023, for an amount not to exceed $40,000; and
b. SUMMARY/DISCUSSION:
A & B Fire Protection & Safety, Inc. (A & B Fire) is a local company that provides fire extinguisher sales and service, fire sprinkler and pre-engineered fire suppression systems, fire alarm systems and other first aid and personal safety equipment in Northern California.
This request supports the use of A & B Fire for fire protection system inspections and repairs at WeatherTech® Raceway at Laguna Seca (WRLS). Services provided by A & B Fire are vital to life and safety of the public and protection of Monterey County’s property. The Division of Occupational Safety and Health (DOSH), better known as Cal/OSHA and the Fire Marshal require annual inspection of fire extinguishers.
The delay in submitting the proposed Agreement (Attachment A) was due to A&D Narigi Consulting, LLC (A&D) procuring services with the vendor in 2021 prior to having a fully executed agreement in place.
County Staff and A&D request the Board of Supervisors approve the proposed retroactive Standard Agreement (Agreement) and authorize the Monterey County Laguna Seca Representative to execute the Agreement and up to three (3) future amendments where the total amendments do not exceed ten percent (10%), or $4,000, of the Agreement amount and do not significantly change the scope of work.
OTHER AGENCY INVOLVEMENT:
The Office of County Counsel and Auditor-Controller’s Office reviewed and approved the proposed retroactive Agreement as to form and fiscal provisions, respectively.
FINANCING:
The cost of the contract services provided by A & B Fire is not to exceed $40,000 for the duration of the Agreement. There is sufficient funding in Laguna Seca Recreation Area Fund 453, Appropriation Unit CAO046, to cover the increased costs in this Agreement in Fiscal Year 2021-22. Future costs for the remainder of the Agreement will be included in the respective fiscal year recommended budget in Fund 453, under its new Appropriation Unit PFP067.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
The recommended action supports the Board of Supervisors Strategic Initiatives for Health & Human Services, Infrastructure, and Public Safety. Inspecting fire protection systems and performing maintenance and repairs in a timely manner will ensure the equipment functions properly, which is essential in maintaining a healthy and safe environment for our guests at WRLS and protecting County Parks’ facility and property.
