a. Authorize the Chair of the Board of Supervisors to execute the First Amendment to the Board of State and Community Corrections Jail Construction Agreement (in substantially the form attached) which corrects a clerical error and allows the Jail Housing Addition Project to proceed under the terms of AB 900 Jail Financing Program Phase II; and
b. Authorize and direct the County Administrative Officer, Resource Management Director, and Sheriff to take such other further actions as may be necessary or appropriate to meet State requirements as defined under the AB 900 Jail Financing Program.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Authorize the Chair of the Board of Supervisors to execute the First Amendment to the Board of State and Community Corrections Jail Construction Agreement (in substantially the form attached), which corrects a clerical error and allows the Jail Housing Addition Project to proceed under the terms of AB 900 Jail Financing Program Phase II; and
b. Authorize and direct the County Administrative Officer, Resource Management Director, and Sheriff to take such other further actions as may be necessary or appropriate to meet State requirements as defined under the AB 900 Jail Financing Program.
SUMMARY/DISCUSSION:
On December 6, 2016, the Chair of the Board of Supervisors executed the Board of State and Community Corrections Jail Construction Agreement for the Monterey County Jail Housing Addition AB 900 Phase II Project.
The proposed First Amendment to the Board of State and Community Corrections Jail Construction Agreement replaces Exhibit B, Section 5, Budget Classification Schedule. This replacement schedule corrects a Board of State and Community Corrections (BSCC) error in the original Budget Classification Schedule on line 6 where $16,000 under In-kind Match was shown inaccurately. The correct amount for that line item is $35,000. The original document total was correct and remains unaffected by this state issued clerical error.
OTHER AGENCY INVOLVEMENT:
Resource Management Agency and the Office of the Sheriff are working jointly with BSCC to meet all State-mandated milestones to maintain the conditional award and move forward to the Construction phase.
FINANCING:
There is no additional impact to the General Fund resulting from the above actions. On July 9, 2013, the Board approved a financing plan, which included the Jail Housing Addition Project. In addition to the State grant of $80 Million, the County has contributed $8.9 Million from Fund 404 for a total project cost of $88,900,000. The project is currently on schedule and on budget.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
The Jail Housing Addition Project promotes public safety through expansion space that accommodates an increase for programs and services to inmates in the correctional system as well as space for County staff.
