RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.                     Authorize the Contracts/Purchasing Officer to execute an Agreement with ReadyTalk for the purpose of hosting webinars, for the period of July 1, 2015 to June 30, 2016 in the amount of $1,032.65; and

b.                     Accept Non-Standard risk provisions (insurance, indemnity, limitation liability and damages) as recommended by the Director of Health; and

c.                     Authorize the Contracts Purchasing Officer to approve up to three future amendments to this Agreement where the total amendment amounts do not exceed ten percent (10%) of the total contract amount and do not significantly change the scope of services.

 

SUMMARY/DISCUSSION:

The Monterey County Health Department (MCHD) Striving to Reduce Youth Violence Everywhere (STRYVE) Program is funded by the Centers for Disease Control and Prevention to prevent youth violence in Salinas.  The goal of STRYVE is to increase the capacity of the MCHD and the violence reduction coalition to prevent youth violence.  As a result of this capacity building mandate, we have used a portion of the funding to provide live and web-based training.  This training function is also incorporated into MCHD’s performance measure, to “ensure that 50% or more of the 55 coalition organizations participate annually in a STRYVE work plan activity to prevent youth violence, using a public health approach.”  The ReadyTalk webinars are a low cost way to connect many different organizations to national experts in youth violence prevention. 

 

STRYVE has made a commitment to our funder to conduct webinar trainings in our FY 2014-15 Work Plan:

Current Budget Period Proposed Objectives and Activities:

Objective 1. Maintain coalition involvement in the implementation of the updated Salinas Violence Reduction Plan, through August 31, 2015. 

Activity:

Conduct at least two webinars based on needs identified within the Implementation Team and Community Alliance for Safety and Peace (CASP) members’ response to the Strategic Plan’s implementation; and conduct two more webinars on topics from the Strategic Plan in order to build coalition capacity, by August 31, 2015.

 

Hosting the webinars is technically somewhat complex, but made easier by the ReadyTalk Program.  The Program has templates for creating invitations, with registration providing the internet link and telephone number for the presentation, at the scheduled time.  There is no charge to the participant for either the audio via telephone or the internet connection to the visuals.  Presenters’ audio and PowerPoint presentations are carried live to audiences at their computers.  Both the presenters and the audience join the webinar from their own computers and telephones.  STRYVE staff participates as the moderator.  Audience participants are able to ask questions and make comments using the chat function of ReadyTalk.  The presentations are recorded and can be downloaded from the ReadyTalk site as an audio-visual .mp4.  These .mp4’s are saved to YouTube with a link from the Health Department website.  The presentations can also be stored on the ReadyTalk site for a fee of 20¢ per minute length, per month, however we try to remove the recordings as soon as possible to avoid this additional cost.

 

Precautions, as recommended by County Information Technology Department will be adhered to as follows: PC will not be left unattended; department will maintain control; browser will be closed immediately after session to terminate connection; use of site will only be used for scheduled event and County business.

 

This work supports the MCHD 2011-2015 Strategic Plan Initiatives: Empower the community to improve health through programs, policies, and activities; and Enhance community health and safety by emphasizing prevention.  It also supports the essential public health services: Inform, educate and empower people about health issues, as well as other community concerns; mobilize community partnerships and action to identify and solve health problems; and enforce laws and regulations that protect health and ensure safety.

 

OTHER AGENCY INVOLVEMENT:

County Counsel and the Auditor-Controller have reviewed this Agreement as to legal form and fiscal provisions respectively.  County Counsel approved the Agreement as to form.  Risk Management has not approved the Agreement; due to the non-standard risk provisions within the Agreement, Board of Supervisors approval is requested. The Agreement does not utilize the County’s standard indemnity or insurance provisions. The indemnity provision provides for mutual indemnification. There is no provision indemnifying the County for third party claims for breach of the confidentiality.  The Agreement contains a provision for limitation of liability. Instead, the County expressly assumes all risks associated with the use of the services.  Consequential or special damages arising from any type of claim are limited to the amount received by the vendor from the County under the Agreement in the prior 12 months. On the other hand, the vendor never comes on site for any reason, so there is no need for auto insurance coverage; no protected health information is intended to be broadcast during the webinars, so the likelihood of a patient privacy breach is low; and the vendor agrees to indemnify the County against third party claims for intellectual property infringement.  A copy of the Agreement is on file with the Clerk to the Board.

 

FINANCING:

This Agreement is fully funded through the Department’s STRYVE grant.  There are sufficient appropriations the Health Department’s (HEA003-8124) Requested Budget for Fiscal Year 2015-16.
