RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Approve and Authorize the Contracts Purchasing Officer or their designee to execute a Memorandum of Understanding (MOU) with California Health and Recovery Solutions, P.C., a California corporation (CHRS), for Early Access and Stabilization Services, for three (3) years from date of execution in the amount of $627,001; and

b. Authorize the Contract and Purchasing Officer or their designee to execute two (2) three (3) year amendments with California Health and Recovery Solutions, P.C., a California corporation (CHRS), for Early Access and Stabilization Services, in the amount designated by the Department of State Hospitals.

 

SUMMARY/DISCUSSION:

This Contract Agreement is in reference to California Health and Recovery Solutions, P.C., a California corporation (“CHRS”), and Trinity County Sheriff's Office. CHRS entered into an agreement with Department of State Hospitals (DSH) on 6/29/2022 giving CHRS the authority, as DSH’s designee, to provide Early Access and Stabilization Services (EASS) to patients deemed incompetent to stand trial (PC 1370).

 

The EASS program uses a hybrid model of providing multidisciplinary restoration services to patients not yet admitted into a JBCT or DSH program.  Specifically, EASS offers a combination of medication management, individual and group-based restoration services before they are admitted into a JBCT or DSH bed.  Some services will be offered in a virtual format while may be offered in person.  All competency treatment services will comply with state and federal regulatory requirements applicable to the JBCT Program, including any DSH policies and procedures related to treatment provided prior to admission to a formal program, Title 15, and NCCHC correctional community standards for mental health care.

 

During EASS, patients will receive restoration services commiserate with their individual needs which may include the following:

 

-Medication management services as well as consideration for Involuntary Medication Orders (IMOs) when clinically indicated.

-Individual restoration services with a Competency Trainer or Clinician.

-Group restoration services with a Competency Trainer or Clinician.

-Psychological assessments.

-Data tracking relative to offered services and restoration rates.

 

Section 4361.7 of the Welfare and Institutions Code states that County jails shall allow the department and any of its contractors or designees reasonable access to its facilities and individuals deemed incompetent to stand trial on a felony charge to provide early access treatment. Therefore, EASS services are in direct compliance with the WIC 4361.7.

 

Deputies assigned to work at the Monterey County Jail will be required to add to their already strenuous duties by assisting with EASS treatment.  The increase in deputy support consists of, but not limited to, patient escorting to medication pass and administration of psychotropic medications, EASS clinical services, psychological assessments, and competency services.

 

The contract with CHRS and DSH allows for county founding utilized by the County Sheriffs’ Offices by the appointment of a dedicated deputy(ies) and accompanying relief factor assigned to support the EASS program or by the combination of fractional part-time deputies supporting the EASS program, at the County Sheriffs’ Office discretion, so long as the EASS services are performed as outlined in the Contractor’s subcontract with the County.

 

OTHER AGENCY INVOLVEMENT:

County Counsel has approved the agreement as to legal form, and the Auditor/Controller has reviewed for fiscal provisions.

 

FINANCING:

The estimated revenue of $209,000 was included in the Sheriff’s FY 2024-2025 Recommended Budget. There are no General Fund Contribution impact resulting from this Board Action.
