Adopt the Negative Declaration for the proposed

Ordinance adding Chapter 10.42 to the Monterey

County Code.

WHEREAS, the County is char ed with protecting the public health, safety, welfare and

the environment by promoting the reduction of solid waste generation and the diversion of solid

waste from landfills. The Integrated Waste Management Act of 1989 Public Resources Code

section 41750 et seq) requires the County to divert its solid waste from landfills through source

reduction, recycling, and composting activities.

WHEREAS, the County is consi ering adoption of an ordinance adding Chapter 10.42 to

the Monterey County Code to establish regulations restricting the use of polystyrene foam food

packaging by food providers in the unincorporated area of the County of Monterey

PLN090146);

WHEREAS, County staff prep ed an Initial Study/Proposed Negative Declaration on the

proposed ordinance pursuant to the California Environmental Quality Act CEQA). Issues that

were analyzed in the Initial Study include: aesthetic resources, agricultural resources, air quality,

biological resources, cultural resources, geology and soils, hazards/hazardous materials,

hydrology/water quality, land use and lanning, mineral resources, noise, population and housing,

public services, recreation, traffic and tr nsportation, utilities and service systems.

WHEREAS, the Initial Study/ roposed Negative Declaration was circulated for public

review from November 13, 2009 through December 21, 2009. The County received nine letters in

support of eliminating the use of polystyrene foam food packaging and one letter questioning the

Initial Study and proposed ordinance.

WHEREAS, on the basis of th whole record before it, including the initial study, staff

reports, comments received, response t comments attached as an exhibit to the April 6, 2010 staff

report, reasons set forth in this resolution, other testimony received, and supporting documents and

materials in the project file, the Board finds that there is no substantial evidence that the proposed

ordinance will have a significant effect n the environment.

WHEREAS, as further explai ed in this resolution and in the response to comments

attached as an exhibit to the April 6, 2 10 staff report, no fair argument supported by substantial

evidence that the proposed ordinance may have a significant effect on the environment has been

made.

WHEREAS, eliminating the use of polystyrene foam food packaging will help maximize

the operating life of area landfills. le it is not economically feasible to recycle polystyrene

foam in Monterey County, some other food packaging alternatives are recyclable locally, such as

clear deli containers and clean aluminum foil. Unlike polystyrene foam packaging, these other

food packaging alternatives can be recycled, thereby reducing the need for virgin resources,

reducing the amount of food packaging being sent to landfills, and lessening the economic and

environmental costs of waste management for businesses and citizens of Monterey County.

WHEREAS, the decomposition of organically derived non-polystyrene foam food

packaging produces greenhouse gases such as methane when disposed of in solid waste disposal

sites. However, the solid waste disposal sites where the County's waste is discarded Monterey

Peninsula Landfill and Johnson Canyon Landfill) are required by state regulations to monitor and

control landfill gas emissions including methane) through the use of active and passive

collection systems. Moreover, the Monterey Peninsula Landfill, operated by the Monterey

Regional Waste Management District, has a cogeneration plant which converts the recovered

methane into electricity, thereby offsetting the local demand for other nonrenewable energy

sources.

WHEREAS, polystyrene foam food packaging, when improperly disposed of or left as

litter, has the potential to break apart into smaller pieces and to become windborne. This propensity

to crumble distinguishes it from other food packaging because the crumbling makes collecting

polystyrene foam litter extremely difficult during clean ups and other litter abatement efforts. A

California Department of Transportation study conducted during 1998-2000 found that polystyrene

foam represents as much as 15 percent of the total volume of litter recovered from storm drains.

WHEREAS, the County investigates reports of illegal dumping and cleans up illegal

dumping sites on County property, roadways, and right-of-ways throughout the unincorporated

county. The County experience is that polystyrene foam food containers or pieces of polystyrene

foam food containers are found at many of these locations.

WHEREAS, the County as a member of the Monterey County Illegal Dumping and

Litter Abatement Task Force) organizes an annual Clean Up Day in April of each year and

supports several efforts throughout the year, including Coastal Clean Up Day and America

Recycles Day, to help clean up illegal dump sites and alleviate litter problems throughout the

County. At many of these sites, polystyrene foam food containers or pieces of polystyrene foam

food containers are collected.

WHEREAS, the use of non-polystyrene food packaging is expected to result in a decrease

in accumulation of litter over the long term. Food packaging derived from plant sources e.g. paper

fiber, cornstarch, bagasse) will biodegrade into organic material over time, unlike polystyrene foam

which will persist in the environment as litter for a much longer period if not otherwise collected.

WHEREAS, in a letter from Julie Packard, Executive Director of the Monterey Bay

Aquarium, she states the health of our oceans continues to be threatened by the persistent influx

of plastics, including polystyrene foam, from land-based sources" Letter to the County of

Resources Control Board, the California Coastal Commission and the Algalita Marine Research

Foundation, 60 to 80 percent of all marine debris and 90 percent of floating debris is plastic

WHEREAS, polystyrene foam itter may harm or kill marine and other wildlife when

ingested. The Monterey Bay Nation 1 Marine Sanctuary MBNMS) indicated that, foamed

polystyrene is of particular cone because it is light, it floats, and it is highly

visible.. Polystyrene foam pieces, whic look like food to many species, is frequently ingested by

wildlife and results in choking, reduced appetite, reduced nutrient absorption, and starvation." The

MBNMS have identified over 100 speci s of plants and animals that are considered special status

species" occurring in Sanctuary waters. Letter to the City of Monterey from Paul Michel,

WHEREAS, the Negative Declaration reflects the County's independent judgment and

analysis.

WHEREAS, the custodian of the documents which constitute the record of proceedings

upon which the County's decision is based is the Environmental Health Bureau of the Monterey

County Health Department, located at 1 70 Natividad Road, Salinas.

WHEREAS, in addition to circ lating the Initial Study/proposed Negative Declaration

for public review between November 3 and December 21, 2009, the Environmental Health

Bureau of the Monterey County Health Department took the following actions to notify the

public: 1) held three public workshops on December 1  3  and 9, 2009 to provide an opportunity

for the public to learn more about the Initial Study and proposed ordinance and ask questions,

raise concerns, or make suggestions; 2) maintained a website containing documents relevant to

the proposed ordinance; and 3) notified all permitted food providers operating in the

unincorporated County and all commenting entities of the Board's scheduled consideration of the

adoption of the proposed Negative Decl ation and ordinance.

WHEREAS, on March 16, 20 0, the Board of Supervisors introduced the proposed

ordinance, waived the reading, and set April 6 at 10:30 a.m. as the time to consider adoption of

the ordinance; and

WHEREAS, on April 6, 2010, the Board of Supervisors received a presentation from

County staff, heard public testimony, c nsidered the proposed Negative Declaration, adopted a

resolution of intent to adopt the propos d ordinance with minor revisions to shorten the grace

period" from 365 days to 180 days and provide one warning before citing a food provider for a

violation and directed staff to bring th proposed ordinance as revised back to the Board for

adoption on April 13, 2010; and

WHEREAS, the revisions to tl e proposed ordinance do not change the environmental

conclusions of the Initial Study; an d

County Counsel Summary

This Ordinance adds Ch ter 10.42 to the Monterey County Code to

establish regulations to restrict the use ofpolystyrene foam food packaging by

retail food facilities in the unincorporated area of the County of Monterey. These

regulations generally prohibit fo d providers from utilizing disposable packaging

that contains polystyrene foam, with specified exceptions. A

A. The purpose of this Chap er is to regulate and limit the use of Polystyrene Foam

Food Packaging by Food Providers in t unincorporated area of the County of Monterey in

order to reduce litter, protect the natural resources of Monterey County, and protect the public

health, safety, and welfare of the citizen of the County.

B. Pursuant to Article XI of he California Constitution, the County of Monterey

may adopt and enforce ordinances and regulations to protect and promote the public health,

safety and welfare of its citizens.

C. The County is charged w th protecting the public health, safety, welfare and

environment by promoting the reduction of solid waste generation and the diversion of solid

waste from landfills. The Integrated Waste Management Act of 1989 Public Resources Code

D. This Chapter is consisted with the Source Reduction and Recycling Element

SRRE) of the Countywide Integrated aste Management Plan 1995) for Monterey County as

adopted under the Integrated Waste Management Act of 1989. The SRRE identifies regulatory

program options, including product bans based upon excessive packaging, non-recyclability,

litter potential, etc."

E. Polystyrene is a plastic rein that is used to make up a wide range of consumer

goods and packaging. In its foam" or  xpanded" state, it is frequently used to produce take out

food containers that are not readily biodegradable.

F. According to a 2004 repo entitled Use and Disposal of Polystyrene In California

 A report to the California Legislature y the California Integrated Waste Management Board

CIWMB), Californians used more than estimated 165,000 tons of Polystyrene in 2001 for

packaging and food service purposes alo e.

G. Polystyrene Foam Food Packaging often litters parks and public places, streets

and roads, waterways, storm drains and eaches. It may also break down into smaller, non-

biodegradable pieces that may harm or ill marine and other wildlife when ingested.

H. According to the Plastic Debris, Rivers to Sea Project implemented by the

California State Water Resources Contr 1 Board, the California Coastal Commission and the

Algalita Marine Research Foundation, 6 to 80 percent of all marine debris and 90 percent of

floating debris is plastic material which ncludes Polystyrene Foam. Gregory, M.R., Ryan, P.G.

1. A California Department of Transportation study conducted during 1998-2000

found that Polystyrene Foam represents s much as 15 percent of the total volume of litter

recovered from storm drains. California. Department of Transportation. 2000. Final Report

J. It is not economically feasible to recycle Polystyrene Foam in Monterey County.

Eliminating the use of Polystyrene Foam will maximize the operating life of area landfills and

will lessen the economic and environme ital costs of waste management for businesses and

citizens of Monterey County.

K. The collection of Polysty ene Foam litter and the disposal of Polystyrene Foam

waste results in direct costs to the County in the form of personnel time, equipment usage, and

disposal fees.

L. As of January 2010, they are approximately two-thousand two-hundred 2,200)

permitted Food Providers located in Monterey County. Approximately four-hundred ninety 490)

permitted Food Providers are in the unincorporated area of the County. County estimates that

when this ordinance takes effect, appro mately one-hundred sixty 160) Food Providers will be

subject to the requirements of this Chapter.

M. Affordably priced non-Polystyrene Foam products are available to Food Providers

in order to comply with the regulations of this Chapter.

The regulations of this Chapter s all apply in the unincorporated area of the County of

Monterey.

ORDINANCE 5156�X��"x��10.42.030 DEFINITIONS

Unless otherwise expressly stated, whenever used in this Chapter, the following terms

shall have the meanings set forth below:

A. Chapter" means Chapter 10.42 of the Monterey County Code.

B. County" means the Co fly of Monterey.

C. Director" or Director o Health" means the Director of the Monterey County

Health Department or his/her designee.

D. Disposable Food Service Ware" means single-use disposable products used by a

Food Provider for serving or transportin Prepared Food or beverages including, but not limited

to plates, cups, bowls, trays, and hinged r lidded containers. Disposable food service ware

includes single-use disposable items such as plastic straws, cup lids, or utensils.

E. Effective Date" means the effective date of Ordinance No. enacting this

Chapter 10.42.

F. Food Packaging" means all bags, sacks, wrapping, containers, bowls, plates,

trays, cartons, cups, straws, and lids on or in which any foods or beverages are placed or

packaged or are intended to be placed or packaged. Food Packaging does not include

Polystyrene Foam coolers and ice chests used for item storage or transportation and/or intended

for reuse.

G. Food Provider" means a operation, whether permanent or nonpermanent, that

stores, prepares, packages, serves, vends or otherwise provides food for human consumption at

the retail level.

H. Person" means any individual, sole proprietorship, firm, association,

organization, partnership whether limited or general), corporation, limited liability corporation,

political subdivision, government agency, municipality, industry, public or private corporation,

trust, joint venture, regulatory authority, or any other entity.

1. Polystyrene" means a thermoplastic petrochemical material utilizing styrene

monomers. Polystyrene includes clear o solid Polystyrene oriented polystyrene").

J. Polystyrene Foam" means and includes expanded Polystyrene processed by any

number of techniques including, but not limited to, fusion of polymer spheres expanded bead

polystyrene"), injection molding, form molding, and extrusion-blow molding extruded foam

polystyrene").

K. Prepared Food" means any food or beverage prepared at the Food Provider's

premises, using any cooking or food preparation technique. Prepared food does not include any

raw uncooked meat, poultry, fish, or eggs unless provided for consumption without further food

preparation.

10.42.040 REGULATIONS

A. Food Providers shall not dispense Prepared Food in any Disposable Food Service

Ware that contains Polystyrene Foam or otherwise sell, hand out, give away, distribute or

otherwise make available for public or customer use any Disposable Food Service Ware that

contains Polystyrene Foam, unless exe ted by this Chapter.

B. To allow Food Providers an opportunity to use remaining stocks of Food

Packaging, Food Providers shall have th2ee hundfed and sixty five 365 one hundred and eighty

180) days from the Effective Date to comply with the regulations of this Chapter. During the

365180-day period, it shall be the policy of the County to encourage voluntary adherence to the

regulations of this Chapter.

10.42.050 EXEMPTIONS

A. Prepared Food made or packaged outside the unincorporated area of the County

but sold in the unincorporated area of the County shall be exempt from the provisions of this

Chapter. Nonetheless, the County shall romote and encourage, on a voluntary basis, the

elimination of all Polystyrene Foam pac aging.

B. Polystyrene Foam cooler and ice chests used by Food Providers for item storage

and/or transportation and intended for re se shall be exempt from the provisions of this Chapter.

C. During an emergency req firing immediate action to prevent or mitigate the loss or

impairment of life, health, property, ore sential public services, Persons providing emergency

relief are exempt from the provisions of his Chapter until such time as the emergency has ceased

or the Director of Health rescinds the ex mption.

10.42.060 ENFORCEMENT

A. The Director of Health shall be primarily responsible for implementation and

enforcement of this Chapter. The Director is authorized to establish guidelines and procedures to

implement this Chapter and to take such action as may be necessary, including inspection of

Food Providers, to monitor compliance ith this Chapter.

B. In the event of a violation of this Chapter or any requirement imposed pursuant to

this Chapter, the County may in its discretion, in addition to all other remedies, take such

enforcement action as is authorized under the Monterey County Code and any other action

authorized by law. A Food Provider shall be allowed one 1) warning prior to the first citation for

a violation of this Chapter.

C. If the County elects to uti ize the administrative procedures set forth in Chapter

1.22 of the Monterey County Code to eorce this Chapter, the Director of Health shall serve as

the Enforcement Official within the meaning of Chapter 1.22.

SECTION 2: SEVERABILITY If any section, subsection, sentence, clause or phrase of

this Ordinance is for any reason held invalid by a court of competent jurisdiction, such a decision

shall not affect the validity of the remaining portions of this Ordinance. The Board of

Supervisors declares that it would have passed this Ordinance and each section, subsection,

sentence, clause, or phrase thereof, irrespective of the fact that one or more sections, subsections,

sentences, clauses, or phrases, be declar d invalid.

SECTION 3: EFFECTIVE DA E. This Ordinance shall become effective on the thirty-

first day after its adoption.

RECOMMENDATION:

It is recommended that the Board of Supervis rs:

a. Adopt a resolution adopting the Negative eclaration prepared on the proposed ordinance Exhibit A);

b. Adopt an ordinance, as modified per the Board of Supervisors' direction on April 6, 2010, adding

Chapter 10.42 to the Monterey County C e to establish regulations restricting the use of polystyrene

foam food packaging by retail food provi ers in the unincorporated area of the County of Monterey

Exhibit B); and

c. Direct the Auditor-Controller to establish n account pursuant to Chapter 1.22.180 of the Monterey

County Code for the purpose of remitting enalties collected under this ordinance to the Health

Department, Environmental Health Burea

SUMMARY/DISCUSSION:

The Director of Health recommends that the oard of Supervisors adopt a Polystyrene Ordinance" for

inclusion in the Monterey County Code Exhibit B). The purpose of the ordinance is to restrict the use of

polystyrene foam food packaging by retail fo d providers in the unincorporated area of Monterey County.

At the March 16, 2010, meeting of the Board of Supervisors, the Board introduced the ordinance, waived

reading, and set April 6 at 10:30 a.m. as the f e to consider adoption of the ordinance.

On April 6, 2010, the Board of Supervisors r ceived a presentation from County staff, heard public

testimony, considered the proposed Negative Declaration, adopted a resolution of intent to adopt the

proposed ordinance with minor revisions, an directed staff to bring the modified proposed ordinance

back to the Board for adoption on April 13, 11 10. The Board-directed revisions are: 1) to shorten the

grace period" from 365 days to 180 days an 2) to allow one warning before citing a food provider for a

violation. The revisions to the proposed ordi ance have been made. The resolution to adopt the Negative

Declaration has also been updated to reflect e Board's action. Exhibit A). The revisions to the

ordinance do not change the environmental c clusions of the Initial Study Exhibit Q.

The project is a proposed ordinance to regulate and limit the use of polystyrene foam food

packaging by retail food providers in th

unincorporated area of Monterey County. These

regulations allow for reasonable measures to protect the environment, reduce solid waste, and

decrease litter throughout the unincorporated county. Currently, there are approximately two-

thousand two-hundred 2,200) permitted food providers located in Monterey County.

Approximately one-hundred and seventy 170) permitted food providers are in the

unincorporated areas of Monterey County. Approximately one hundred and sixty 160) food

providers may be subject to the requirements of this proposed ordinance.

A three hundred and sixty-five 365) day grace period" has been incorporated to allow food

providers adequate time to expend current stocks of non-compliant food packaging.

B. Environmental Setting and Surrounding Land Uses:

The County of Monterey is located on t e Central Coast of California and is approximately 100

miles south of San Francisco and 240 miles north of Los Angeles. It is bordered by Santa Cruz

County to the north, San Benito, Fresno and Kings Counties to the east and San Luis Obispo

County to the south. The proposed ordi ance is applicable to all zoning districts and applies to

all unincorporated areas of Monterey C unty. Monterey County contains a mix of different land

uses. Agricultural land uses predominantly define inland areas of the County from King City to

the south and northwards past Salinas. Residential land uses are located throughout the County,

especially in the heavily residential citi s of Monterey, Carmel, Pacific Grove, Marina, Salinas,

and Seaside.

where local permit requirements are not triggered. This proposed project will not conflict with

any local policies or ordinances prote ting biological resources or with the provisions of an

adopted Habitat Conservation Plan, Natural Community Conservation Plan, or other approved

local, regional, or state habitat conservation plan. Therefore, the proposed project will have no

Cultural Resources

The County contains a wide variety of historical and archeological resources. These resources

are both locally and nationally significant. By reducing the amount of polystyrene foam food

packaging generated, the County's historical and archeological resource will be cleaner and

more easily maintained. The proposed project will not affect known historic resources,

archaeological resources, paleontological resources, unique geologic features or human remains.

Geology and Soils

This proposed project will not expos people or structures to the effects of earthquake fault

rupture, seismic shaking, ground failure, landslides, soil erosion, unstable soil, or expansive soil.

The proposed project will not include he use of septic tanks. The use of non-polystyrene foam

over polystyrene foam food packagi g does not involve any land use activities or actions;

therefore, the proposed project will hay no impact on geology and/or soils. Source: 1, 2)

Hydrology and Water Quality

This proposed project will regulate he use of polystyrene foam food packaging, thereby

reducing the amount of small" permanent litter in county waterways, storm drains, and beaches

and potentially improving county wate quality. This project will provide reasonable protection

of beneficial uses and the prevention o nuisance" in accordance with the State Water Resource

Control Board's Ocean Plan, Section II.C.1, Floating particulates... shall not be visible" in

ocean waters. Furthermore, the Central Coast Regional Water Quality Control Board's Basin

Plan, Section II.A.2.a states as a general objective for all inland surface waters, enclosed bays,

and estuaries, waters shall not contai floating material, including solids, liquids, foams, and

scum, in concentrations that cause nuis nce or adversely affect beneficial uses."

The County concludes that the u e of organic non-polystyrene foam food packaging will

have a less than significant impact on greenhouse gas emissions. The solid waste

disposal sites where the County' waste is discarded Monterey Peninsula Landfill and

Johnson Canyon Landfill) are required by state regulations to monitor and control landfill

gas emissions including meths  through the use of active and passive landfill gas

collection systems. Moreover, the Monterey Peninsula Landfill, operated by the

Monterey Regional Waste Mana ement District, has a cogeneration plant which converts

the recovered landfill gas into el ctricity, thereby offsetting the local demand for other

nonrenewable energy sources. I the end, the landfill gases produced due to the use of

non-polystyrene foam food pack ging are controlled and managed in ways that make

emission impacts less than signi scant.

It is important to note that the C unty's primary goal in implementing this proposed

project is to reduce the amount f litter and the impact to the natural environment due to

polystyrene foam food packagin Y.

d-e) This proposed project will not have any construction-related air quality impacts or expose

sensitive receptors to substantial pollutant concentrations since the use of non-

polystyrene foam food packaging will have no direct or indirect impacts on these items.

As stated in Section 3.c. above, rganic decomposition of non-polystyrene foam food

packaging may create objectionable odors in the form of methane gas. As discussed

previously, disposal sites have a tive and passive collection systems to capture methane

gas. Additionally, solid waste f cilities landfills and composters) are required by state

regulations to maintain Odor Impact Minimization Plans OIMP). Between these two

considerations, this project will of create objectionable odors affecting a substantial

number of people.

facilities. In some instances, wastewater treatment and storm water drainage facilities

may see improvements in c rrent operations by reducing the amount of non-

biodegradable polystyrene foam food packaging that are introduced into the systems.

f-g) The total amount of food packaging will not be affected by this ordinance since the

number of food facilities restau ants, markets, cafes, etc.) is not changing. By replacing

polystyrene foam food packagi g with products that will biodegrade or can be recycled

locally, it will likely result in reduction in the total amount of food packaging that

ultimately reaches the landfill. Furthermore many non- polystyrene foam food packaging

disposed in landfills will degrad more quickly over time, ultimately using less airspace.

The two landfills that will ultim tely serve this ordinance will be the Monterey Peninsula

Landfill and the Johnson Canyon Sanitary Landfill. Between these two landfills, there is

over 130 years of landfill capac ty in Monterey County. This ordinance is not expected

to cause an increase in the total amount of food packaging generated; however, both

landfills have the capacity t accept additional solid waste. Furthermore, since

polystyrene foam is easily wind-borne as refuse vehicles dump their loads at the landfills,

a reduction in food packaging reaching the landfill may help reduce wind-borne litter and

assist the landfill facility to remain compliant with litter control regulations. The

proposed ordinance will have no impact, but will be beneficial in some cases.
