RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.                     Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to execute an Agreement with the County of Monterey and Labworks, LLC for the provision of software subscription, software maintenance/support, and technical support services; in the amount of $58,472.62, for the period retroactive from November 1, 2015 to October 31, 2018; and 

b.                     Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to sign up to three (3) future one year amendments, where the amendments in the aggregate do not exceed (10%) ($5,847) of the original Agreement amount and do not significantly alter the scope of services.

 

SUMMARY/DISCUSSION:

The Monterey County Health Department has been utilizing Laboratory Information Management System (LIMS) software since 2000. This is for the provision of software license subscription, software maintenance/support, and technical support services not covered under the recurring cost of the software subscription.  This software is a laboratory information management system used to log in samples, assign, schedule, and track testing performed by the lab.   

 

The start date of the Agreement is retroactive to November 1, 2015 due to the lengthy process necessary to negotiate with the original vendor, Perkin Elmer Labworks Laboratory Information System (LIMS) and their exceptions to the County standard terms, conditions, and liability provisions.  During the final negotiations with Perkin Elmer Labworks LIMS, a subsequent change in ownership of PerkinElmer Labworks LIMS to Labworks, LLC occurred further delaying the Agreement.  The required renewal of negotiations with Labworks, LLC prohibited the Agreement from being brought forward until this time. The approval of this recommendation action will enable Health Department, Public Health Bureau, and Laboratory to continue the use of this software to track data, test results, and invoice for services.  Labworks, LLC has accepted all of the County standard terms, conditions, and liability provisions and as such it is the recommendation of the Interim Director of Health to receive approval for this retroactive Agreement. 

 

This work supports the MCHD 2011-2015 Strategic Plan Initiative; empower the community to improve health through programs, policies, and activities; and enhance community health and safety by emphasizing prevention.  It also supports several of the essential public health services: mobilize community partnerships and action to identify and solve health problems; link people to needed personal health services and assure the provision of health care when otherwise unavailable; and assure competent public and personal health care workforce.

 

OTHER AGENCY INVOLVEMENT:

County Counsel, Risk Management, and the Auditor-Controller have reviewed and approved this Agreement as to legal form, liability and fiscal provisions respectively. 

 

FINANCING:

There are sufficient appropriations in Health Department’s Public Health (HEA003) Adopted Budget for FY 2015-16 to accommodate this action.  The requested contract is funded 64% through laboratory fee revenue and 36% with Public Health Realignment.
