Title: a. RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.  Approve and authorize the execution of a Memorandum of Understanding (MOU) between the County of Monterey and the Monterey Regional Waste Management District, dba ReGen Monterey (“MRWMD”), for a total of $40,691 to procure recovered organic waste products on behalf of the County to meet organic waste procurement targets as required by California’s Short-Lived Climate Pollutants Reduction Law; and
b.  Approve the retroactive application of the MOU to November 1, 2024, to ensure the County meets 65% of the 2024 procurement target and 100% of the required targets in 2025 and 2026, pursuant to California Code of Regulations, Title 14, Sections 18993.1 through 18993.4.; and
c. 
Approve and authorize the Director of Health Services or designee to sign the MOU. 

SUMMARY/DISCUSSION:
Senate Bill 1383 (SB 1383), California’s Short-Lived Climate Pollutants Reduction Law, mandates that jurisdictions procure recovered organic waste products to support the reduction of greenhouse gas emissions. Under this law, CalRecycle has set procurement target goals that each jurisdiction must meet annually.

To comply with SB 1383 regulations, the County of Monterey intends to enter into a Memorandum of Understanding with MRWMD, dba ReGen Monterey. MRWMD possesses the necessary capacity and expertise to procure recovered organic waste products, including finished compost or mulch, from certified processors.

California Code of Regulations (CCR), Title 14, Sections 18993.1 through 18993.4, requires jurisdictions to procure and utilize a minimum quantity of recovered organic waste products each year, measured by a procurement target set by CalRecycle.

This MOU will:

                     Authorize MRWMD to procure finished compost or mulch on behalf of the County from certified processors;

                     Support the County’s efforts to comply with SB 1383 requirements for the western unincorporated areas of Monterey County;

                     Be retroactive to November 1, 2024, ensuring the County captures 65% of the 2024 target and positions itself to achieve full compliance (100%) for the 2025 and 2026 targets.


Partnering with MRWMD ensures that the County leverages existing regional waste management resources and expertise in a cost-effective and sustainable manner.

While this work is not directly in support of a Health Department strategic goal, it is in
support of one or more of the ten essential public health services, specifically: (4)
Mobilize community partnerships and action to identify and solve health problems and (10) Research for new insights and innovative solutions to health problems.

 

OTHER AGENCY INVOLVEMENT:

Monterey Regional Waste Management District (ReGen Monterey), California Department of Resources Recycling and Recovery (CalRecycle). The Office of County Counsel has reviewed as to form. 

FINANCING:
There is no cost to General Fund Contribution, the funding source to offset the expenditures will come from the Unified Franchise revenue (Revenue 4270, Unit 8113), which is declared in the Adopted Budget for Fiscal Year (FY) 2025-26.
