SUMMARY:
On May 5, 2023, the Board approved an Agreement with Sicuro Data Analytics, LLC for statistical analysis services in the amount of $150,000, Agreement No. A-16262. The Agreement was subsequently amended to extend the term through December 31, 2027, and increase the maximum contract amount to $371,100 for continued services.
Approval is requested to further amend the Agreement with Sicuro Data Analytics, LLC to provide additional statistical analysis services from November 13, 2026 through November 12, 2027, increasing the maximum contract amount from $371,100 to $401,100, an increase of $30,000.
These additional services will examine the impact of California's early release laws, including Proposition 57, Elderly Parole, and Youthful Offender Parole, which allow certain incarcerated individuals to be considered for release before completing their original sentences. The analysis will evaluate time served and whether individuals commit new crimes after release to better understand the impact of these laws on public safety.
DISCUSSION:
Sicuro Data Analytics provides specialized statistical analysis services to the Monterey County District Attorney’s Office to support compliance with the Racial Justice Act and Assembly Bill 11071. These services support the District Attorney’s Office by ensuring criminal justice data is accurate and complete, providing statistical analysis, and offering expert consultation and testimony as needed.
On May 5, 2023, the Board approved an Agreement with Sicuro Data Analytics, LLC for statistical analysis services in the amount of $150,000, Agreement No. A-16262. Subsequent amendments extended the Agreement through December 31, 2027, and increased the maximum contract amount to $371,100.
The proposed amendment will provide these additional services from November 13, 2026 through November 12, 2027, and increase the maximum contract amount from $371,100 to $401,100, an increase of $30,000.
The proposed amendment will expand the scope of statistical analysis services to examine the impact of California's early release laws, specifically Proposition 57, Elderly Parole, and Youthful Offender Parole. These laws provide opportunities for certain incarcerated individuals to be considered for release based on factors such as their offense, age, and time served, potentially allowing them to be released before completing their original sentences.
The study will examine how these laws affect the amount of time individuals spend incarcerated and whether they commit new offenses following their release. Sicuro Data Analytics will analyze criminal justice data from participating counties, along with available state prison and parole records, to compare release eligibility, actual release dates, time served, and subsequent criminal activity. The findings will help the District Attorney's Office better understand how these early release laws are being applied and their potential impact on public safety.
OTHER AGENCY INVOLVEMENT/COMMITTEE ACTIONS:
County Counsel has approved the Agreement as to legal form. Risk Management has reviewed the Agreement. The Auditor-Controller has approved as to fiscal provisions.
FINANCING:
The Fiscal Year 2026-27 Adopted Budget for the District Attorney, Fund 1001, Entity 224002, includes sufficient appropriations for this amendment. Funding for this Agreement for Fiscal Year 2027-28 will be provided through State Community Corrections Partnership (CCP) funds and included in the budget preparation process. There will be no increase in the General Fund Contribution resulting from this Board action.
BOARD OF SUPERVISORS STRATEGIC PLAN GOALS:
