Title

Receive a report for the quarter ending June 30, 2024, on the status of the Boronda County Sanitation District (BCSD) - Zone 2 San Jerardo Water System.

Report

RECOMMENDATION:

It is recommended that the Capital Improvement Committee receive a report for the quarter ending June 30, 2024, on the disposition status for the Boronda County Sanitation District (BCSD) - Zone 2 San Jerardo Water System.

BACKGROUND:

The County owns and operates the Pajaro County Sanitation District (PCSD), Boronda County Sanitation District (BCSD), County Service Area 75 - Chualar sanitation system (CSA 75-Chualar), and the Boronda County Sanitation District -Zone 2 San Jerardo Water system (San Jerardo System).  Formal efforts to sell or transfer the sanitation systems began with the issuance of a Request for Proposal in April 2016 and again in October 2022.  After review and consideration of submittals, no viable transfer options were identified.  Staff have continued to be in contact with other agencies to explore interest in transfer.

DISCUSSION:

BCSD - Zone 2 - San Jerardo Water System:

The System is owned and operated by the BCSD - Zone 2.  The San Jerardo Housing Cooperative, Inc. (Cooperative) has started the application process to form the San Jerardo Mutual Water Company.  Formation of a mutual water company is required by the State prior to transferring ownership of the System from the BCSD-Zone 2 to the (proposed) San Jerardo Mutual Water Company.  Working with a legal team from UC San Francisco Law, the Cooperative has received preliminary approval of the required Technical, Managerial and Financial (TMF) report from the County Health Department, Environmental Health Bureau, Drinking Water Protection.  TMF capacity is required by the State of California, Department of Drinking Water, prior to transfer of the ownership of the System to the proposed Mutual Water Company.  Meetings between Public Works, Facilities and Parks (PWFP) - Special Districts staff, the Cooperative, and their legal team continue to follow the progress of the Cooperative’s pending application to form a Mutual Water Company and the status of the System improvements with need to be completed by BCSD-Zone 2 prior to any transfer of the system.
