a. Authorize the Director of Health to execute the Vital Records Business Intelligence System (VRBIS”) Data Use and Disclosure Agreement with the California Department of Public Health (“CDPH”) for a term of three years after the last signature date in the signature block of the Agreement;
b. Accept Non-Standard indemnity provision as recommended by the Director of Health; and
c. Authorize the Director of Health to execute up to three future amendments to this Agreement where the amendments do not significantly change the scope of services

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Authorize the Director of Health to execute the Vital Records Business Intelligence System (VRBIS”) Data Use and Disclosure Agreement with the California Department of Public Health (“CDPH”) for a term of three years after the last signature date in the signature block of the Agreement;
b. Accept Non-Standard Contract indemnity provisions as recommended by the Director of Health; and
c. Authorize the Director of Health to execute up to three future amendments to this Agreement where the amendments do not significantly change the scope of services
SUMMARY/DISCUSSION:
Vital Records Business Intelligence System (VRBIS) is a secure, web based electronic data warehouse used by CDPH to store the state’s vital records data, including birth, death, and fetal death data. Secure access will be provided to the Health Department to access county-specific vital records data. The data will be used for epidemiologic analysis, surveillance, and program evaluation, as directed by the Monterey County Health Officer, in support of the core public health functions of assessment and policy development to improve our community’s health status and reduce disparities. CDPH has shared county-specific vital records data with the Monterey County Health Department (MCHD) by mailing encrypted data on disks. VRBIS will provide real-time access to county vital records data while following state and federal safeguards for the protection of personal and confidential information. VRBIS will now serve as the only method for MCHD to obtain the data. CDPH’s Agreement terms and conditions are non-negotiable.
This work supports the MCHD 2011-2015 Strategic Plan Initiatives: empower the community to improve health through programs, policies, and activities; and to enhance community health and safety by emphasizing prevention. It also supports several of the ten essential public health services: monitor health status to identify and solve community health problems; diagnose and investigate health problems and health hazards in the community; inform, educate, and empower people about health issues; develop policies and plans that support individual and community health efforts; evaluate effectiveness, accessibility, and quality of personal and population-based health services; and research for new insights and innovative solutions to health problems.
OTHER AGENCY INVOLVEMENT:
County Counsel, Risk Management and the Auditor-Controller have reviewed this Agreement as to legal form, liability and fiscal provisions respectively. County Counsel approved as to form. Risk Management has not approved as to risk. Auditor Controller has approved as to fiscal provisions. A copy of the Agreement is on file with the Clerk to the Board.
FINANCING:
There is no exchange of funds between CDPH and County associated with this Agreement.
