RECOMMENDATION:

It is recommended that the Board of Supervisors:

Approve and authorize the Director of Health or Assistant Director of Health to execute a no-extension of Amendment No. 3 (retroactive to July 1, 2017) for Alcohol and/or Drug Service Agreement A-12777 with Community Human Services for the provision of alcohol and drug recovery services for Fiscal Year (FY) 2016-17, and an increased amount of $181,589 for FY 2017-18, for a revised total Agreement amount not to exceed $7,533,053 for the term of July 1, 2015 - June 30, 2018.

 

SUMMARY/DISCUSSION:

Community Human Services (CHS) provides residential and non-residential alcohol and drug recovery services for Medi-Cal, Non-Medi-Cal, Drug Treatment Court and CalWORKS eligible Monterey County residents. CHS continues to provide services to Monterey County men and women age 18 or older with primary addiction to drug(s). Intravenous drug users and HIV+ clients will receive priority admission.

 

This Amendment No. 3 revises the FY 2017-18 drug treatment rates to reflect FY 2017-18 Drug Medi-Cal rates published by the Department of Health Care Services (DHCS), increases units of service and Drug Medi-Cal funding for Program 3 Narcotic Treatment Program and reduces units of service and funding for program 6 Outpatient Drug Free for FY 2016-17. The FY 2016-17 change in units of service is needed to provide Drug Medi-Cal funded methadone services due to an increase in census in the last quarter of individuals in our community in need of narcotic replacement therapy. The Health Department’s Behavioral Health Bureau who oversees Substance Abuse Prevention and Treatment funding within the County of Monterey is required by law to provide narcotic replacement therapy to Medi-Cal eligible community members in need of such services.

 

In Fiscal Year 1994-95 (Sobkey vs. Smoley) the federal court ruled that Medi-Cal funded services are entitlement programs and must be provided to all eligible Medi-Cal beneficiaries. No person eligible for Drug Medi-Cal certified treatment services can be denied services or placed on a waiting list for such services due to budgetary constraints.

 

Amendment No. 3 is retroactive to July 1, 2017 because DHCS did not release the rates in time to amend the contract prior to the beginning of the Fiscal Year 2017-18 start date.

 

This Agreement contains the County’s standard 30-day “no cause” provision (Section 5) and a defunding provision (Section 6), which provides the County the ability to amend or terminate the Agreement in the event of a reduction and/or termination of funding.

 

This work supports the Monterey County Health Department 2011-2015 strategic plan initiative: 3) Ensure access to culturally and linguistically appropriate, customer-friendly, quality health services.  It also supports one of the ten essential public health services, specifically: 7) Link people to needed personal health services and assure the provisions of health care when otherwise unavailable.

 

OTHER AGENCY INVOLVEMENT:

County Counsel and Auditor-Controller have reviewed and approved this Agreement as to legal form and fiscal provisions, respectively.

 

FINANCING:

This Agreement is funded by 23% Federal Substance Abuse Prevention & Treatment (SAPT), 57% Drug Medi-Cal, 13% State Funds Behavioral Health Sub Account, and 7% AB 109 funding.  The funds for FY 2016-17 have been included in the Health Department’s Behavioral Health Bureau (HEA012), Unit 8410) FY 2016-17 Adopted Budget.  The funds for FY 2017-18 will be included in the Health Department Behavioral Health (HEA012, Unit 8410) FY 2017-18 Recommended Budget.
