a. Approve Professional Services Agreement (PSA) with CONSOR North America, Inc. to provide bridge design services for the Bridge Preventative Maintenance Program (BPMP) Paint Bridges Project located throughout the County of Monterey, County Project #1184, Federal Project #BPMPL-5944(140), Request for Proposals (RFP) #10948, for an initial term of three years effective March 24, 2026 to March 23, 2029, with the option to extend the term for two additional one-year periods, for an amount not to exceed $656,000;
b. Approve additional term extensions for the PSA beyond the anticipated five-year term of RFP #10948 with no change in the scope of work or increase to the dollar amount to allow continuity of services initiated during the anticipated five-year term of the PSA, subject to review and approval as to form by the Office of the County Counsel; and
c. Authorize the Director of Public Works, Facilities and Parks or their designee to execute the PSA and future amendments to the PSA where the amendments do not significantly alter the scope of work or increase the amount by more than 10% ($65,600) of the original approved PSA amount of $656,000 bringing the potential overall aggregate not to exceed amount to $721,600 subject to review and approval as to form by the Office of the County Counsel and as to fiscal provisions by the Auditor-Controller’s Office.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. SUMMARY:
The County of Monterey, Department of Public Works, Facilities and Parks (PWFP) has identified a need for bridge design services for the Bridge Preventative Maintenance Program (BPMP) Paint Bridges Project (Project).
The recommended actions will establish a Professional Services Agreement (PSA) with CONSOR North America, Inc. (CONSOR) to provide bridge design services for nine bridge projects located throughout the County. In general, CONSOR’s scope of work includes preparing construction plans and specifications for the removal of existing paint, repair of damaged bridge components, and repainting of both substructure and superstructure elements for nine bridges. The nine bridges, including their names, identification numbers, and locations are presented in the table below:

DISCUSSION:
On March 28, 2025, PWFP solicited Proposals from qualified consultants through Request for Proposals (RFP) #10948 for bridge design services for the BPMP Paint Bridges Project. On May 9, 2025, PWFP received Proposals from four consultants. The proposals were subjected to a competitive selection process that was conducted in accordance with County policies and State and Federal laws under RFP #10948. As a result of this competitive process, CONSOR was selected as the most qualified consultant for their expertise and capabilities in providing bridge design services.
Board of Supervisors (Board) approval would allow for the issuance of a PSA between the County and CONSOR to provide bridge design services for the Project, for an initial term of three years effective March 24, 2026 to March 23, 2029, with the option to extend the term for two additional one-year periods, for an amount not to exceed $656,000.
Attachments A through C are provided for reference and include a draft of the proposed PSA, Project Budget, and Location Map. Attachments D through G include RFP #10948 and Addendums No. 1 through 3 to RFP #10948.
OTHER AGENCY INVOLVEMENT/COMMITTEE ACTIONS:
The Office of the County Counsel and the Auditor-Controller’s Office have reviewed and approved the PSA as to form and fiscal provisions, respectively.
FINANCING:
The total estimated cost of the Project, including design engineering, environmental, right of way, utilities and construction is $6,272,480. The County has secured the majority of Project funds in the amount of $4,473,392 from the Highway Bridge Program (HBP) and the remainder in the amount of $1,799,088 will be funded by Measure X funds. Please refer to Attachment B, Project Budget, for further details.
As shown, the Project budget for Design Engineering and Environmental is $997,480. PWFP staff directed CONSOR to perform these services in two phases: Phase 1 - Preliminary Engineering, for an amount not to exceed $257,000, and Phase 2 - Final Design, for an amount not to exceed $399,000, for a combined total amount not to exceed $656,000 for the PSA. Phase 3 - Construction is included in the PSA as an optional phase. The costs associated with the PSA are anticipated to be incurred over the next three fiscal years (FY): 2025-26, 2026-27, and 2027-28.
This Project is included in the County’s current 5-Year Capital Improvement Program and Annual Work Program for Road Fund. Work on Phase 1 of the Project will begin immediately upon execution of the PSA. There are sufficient appropriations adopted in the FY 2025-26 Road Fund 002, Unit 8558, Appropriation Unit PFP004 to finance Phase 1 of the Project. Once complete funding is secured for future phases of the Project (Phase 2 and Phase 3), the County will issue CONSOR a notice to proceed. If necessary, additional actions will be brought forward to the Board after funding has been identified.
BOARD OF SUPERVISORS STRATEGIC PLAN GOALS:
The recommended action aligns with the Board’s Strategic Plan Goals for Sustainable Infrastructure, both now and in the future. The Project’s bridge design services, including bridge painting, for the nine identified bridge projects fall under the broader BPMP, which is focused on extending bridge service life through pre-approved preventative maintenance activities that enhance the safety and longevity of the County’s infrastructure.
