a. Approve and authorize the Interim Director of the Information Technology Department, or his designee, to sign an agreement with the State of California, for its use of County telephones at the America’s Job Center of California located at 730 La Guardia Street, Salinas, CA, retroactive to July1, 2016 through June 30, 2017 at a maximum cost of $13,740.00; and
b. Authorize the Interim Director of the Information Technology Department, or his designee, to sign up to five (5) renewals to the agreement, of one year each, on the same terms or on terms that are substantially similar to the current Agreement.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Interim Director of the Information Technology Department, or his designee, to sign an agreement with the State of California, for its use of County telephones at the America’s Job Center of California located at 730 La Guardia Street, Salinas, CA, retroactive to July1, 2016 through June 30, 2017 at a maximum cost of $13,740.00; and
b. Authorize the Interim Director of the Information Technology Department, or his designee, to sign up to five (5) renewals to the agreement, of one year each, on the same terms or on terms that are substantially similar to the current Agreement.
SUMMARY/DISCUSSION:
The Information Technology Department (ITD) oversees this agreement which allows the State of California Employment Development Department (EDD) to use the County phone system located in EDD’s office at the America’s Job Center of California. EDD staff share this County-maintained office with the One Stop Career Center operated by the Monterey County Workforce Development Board. Although its terms are non-standard to the County, it is the standard agreement used by the State of California for similar services throughout the state. This renewal agreement was just received from the State and will be retroactive to July 1, 2016.
ITD’s Interim Director further recommends that the Board authorize the Director of the Information Technology Department, or designee, to execute five (5) additional renewals of this lease, of one year each, through June 30, 2022, on the same or substantially similar terms to the current lease.
OTHER AGENCY INVOLVEMENT:
County Counsel has reviewed the agreement with the State of California as to form. County Counsel cannot approve the agreement due to the following, non-standard provisions: EDD option to terminate on 30-days’ notice; option to submit disputes to non-binding arbitration; and absence of standard indemnification/insurance provisions in favor of the County.
FINANCING:
The approval of this agreement will allow ITD to continue to be able to bill and accept payment for this service. Approval of this agreement will have no impact on the general fund as the cost of providing this service is offset by the payment provided by the State of California.
