a. Award a contract to Granite Construction Company, the lowest responsible bidder for the Monterey County Seal Coat FY21 for Various Roads, Project No. 5521, to place seal coat on Crazy Horse Canyon Road (San Juan Grade Road to Executive Drive), Laureles Grade (Carmel Valley Road to SR-68), and Carmel Valley Road (Tassajara Road to mile post 30), approximately 16 centerline road miles;
b. Approve the Performance and Payment Bonds executed and provided by Granite Construction Company;
c. Authorize a contingency, not to exceed ten percent (10%) of the contract amount or $165,237, to provide funding for approved contract change orders;
d. Authorize the Director of Public Works, Facilities and Parks to execute the contract and, subject to the terms of the Public Contract Code, approve change orders to the contract that do not exceed ten percent (10%) of the original contract amount and do not significantly change the scope of work; and
e. Authorize the Director of Public Works, Facilities and Parks to execute a Certificate of Completion and record a Notice of Completion with the County Recorder when the Director determines that the contract is complete in all respects in accordance with the Plans and Special Provisions for the construction of Monterey County Seal Coat FY21 for Various Roads, Project No. 5521.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Award a contract to Granite Construction Company, the lowest responsible bidder for the Monterey County Seal Coat FY21 for Various Roads, Project No. 5521, to place seal coat on Crazy Horse Canyon Road (San Juan Grade Road to Executive Drive), Laureles Grade (Carmel Valley Road to SR-68), and Carmel Valley Road (Tassajara Road to mile post 30), approximately 16 centerline road miles;
b. Approve the Performance and Payment Bonds executed and provided by Granite Construction Company;

SUMMARY/DISCUSSION:
Annually, Public Works, Facilities, & Parks Department (PWFP) performs seal coat pavement maintenance on County roads. This year’s Annual Seal Coat project consists of treating Crazy Horse Canyon Road (San Juan Grade Road to Executive Drive), Laureles Grade (Carmel Valley Road to SR-68), and Carmel Valley Road (Tassajara Road to mile post 30), approximately 16 total centerline miles.
On March 9, 2021, the Board of Supervisors adopted the Plans and Special Provisions for the Monterey County Seal Coat FY21 for Various Roads, Project No. 5521. The project was subsequently advertised, and bids were received and opened on April 2, 2021. Six bids were received. The lowest responsive responsible bidder for the project was Granite Construction Company in the amount of $1,652,374, which is 13.5% under the Engineer’s Estimate of $1.9 million. The second lowest bidder was Northwest Paving Inc. in the amount of $1,756,302. Construction is anticipated to begin in May 2021.
The project has been determined to be categorically exempt (Class 1) from the California Environmental Quality Act (CEQA) because it is to perform repair and maintenance of existing streets and similar facilities, which involves no expansion of an existing use (See CEQA Guidelines, California Code of Regulations (CCR) Section 15301 Existing Facilities).
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel and Contracts/Purchasing attended the bid opening and reviewed the low bid for conformance with applicable regulations. The Office of the County Counsel-Risk Management, and Auditor-Controller’s Office have reviewed and approved the contract and bonds as to form, insurance and indemnification, and fiscal provisions, respectively.
FINANCING:
The total estimated project cost for the Seal Coat FY21, including engineering, construction management, and construction is $2.0 million.
The FY 2020-21 budget includes $2.0 million in appropriations in the Road Fund 002, Unit 8443, Appropriation Unit RMA012 to finance this project. The Seal Coat FY21 project’s financing source is the Transient Occupancy Tax (TOT).
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
The contract for the Seal Coat FY 2020-21 project, which will maintain and extend the useful life of the County’s transportation infrastructure. The Seal Coat FY 2020-21 is consistent with the Pavement Asset Management Plan and Annual Maintenance Plan.
