Report
RECOMMENDATION:
It is recommended that the Board of Supervisors:
a.      Approve the application and submission of the Local Area Designation and Local Board Certification under Workforce Innovation and Opportunity Act (Public Law 113-128) Sections 106 and 107; and
b.      Authorize the Chairman of the Board of Supervisors to sign the application
 
SUMMARY:
In accordance with Section 106 and 107 of the Workforce Innovation and Opportunity Act of 2014 (WIOA), Monterey County, through the Monterey County Workforce Development Board (WDB), seeks to submit an application for Existing Local Area Designation and Local Board Certification under the WIOA.
 
The State of California Employment Development Department (EDD) issued a final Directive on February 20, 2015 (revised March 6, 2015) setting forth policies and procedures regarding (1) the initial designation of local areas and (2) the initial certification of local boards under the new Workforce Innovation and Opportunity Act of 2014.
 
The policies and procedures are intended to provide maximum flexibility to local areas during the initial two years of WIOA implementation.  Flexibility will allow local areas sufficient time to prepare for and fully comply with new WIOA requirements for "subsequent" local area designation and local board recertification.
 
WIOA Sections 106 and 107 provide the criteria for the initial designation of local areas and initial certification of local boards.  Under WIOA Section 106, the Governor shall approve a request made for initial designation by any local area if, during Program Years (PY's) 2012-13 and 2013-14, the local area:
 
(1)      Was designated as a Local Workforce Investment Area under WIA;
(2)      Performed successfully by achieving at least 80 percent of their local performance goal on each performance measure; and
(3)      Sustained fiscal integrity.
 
 
 
Local WIBs are required to complete an "Existing Local Area" application for initial designation and submit it to the State of California EDD no later than March 31, 2015.  Upon approval of the initial designation, the existing local board will be certified through PY 2016-17.  Initial designation is effective July 1, 2015 - June 30, 2017.  Local areas that would like to modify their current geographical boundaries are eligible to apply under their new structure by completing the "modified Local Area" application.
 
Subsequent designation will be effective July 1, 2017.  During the initial designation period, it's recommended that local areas should be planning and preparing to meet the WIOA requirements for subsequent designation to include achievement of successful performance and sustained fiscal integrity, and in the case of a local area in a planning region, to meet the regional planning requirements of WIOA.  Additionally, local areas should be preparing to meet the new Office of Management and Budget (OMB) Omni-Circular regulations which apply to new awards and additional funding increments to existing awards made after December 26, 2014.
 
DISCUSSION:
In accordance with the WIOA criteria for initial designation of local areas and initial certification of local boards, Monterey County Workforce Investment Board (WIB) has met the following requirements:
 
(1)      Was designated a Local Workforce Investment Area in December 2000 and received Local Board certification to fully implement the Workforce Investment Act (WIA) in the local area of Monterey County;
(2)      Successfully met and or exceeded its local performance goal on each performance measure for PY's 2012-13 and 2013-14; and
(3)      Successfully met all fiscal integrity through State of California monitoring reviews for PY's 2012-13 and 2013-14.
 
Meeting performance goals is defined by the Stated EDD as meeting 80% of a performance goal. The Monterey County Workforce Investment Board exceeded performance goals on 14 of 18 performance measures for Program Years 2012-13 and 2013-14 and met 80% of performance goals on 4 other performance measures, with the result that it has met each and every performance goal for these programs years.
 
OTHER AGENCY INVOLVEMENT:
This application has been approved by County Counsel as to form.
 
FINANCING:
This application has no effect on the general fund. Future formula allocations approved by the State Employment Development Department Workforce Services Division are contingent upon Local Area Designation under the Workforce Innovation and Opportunity Act of 2014.
