RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.                     Approve and authorize the Contracts/Purchasing Officer or their designee to execute Amendment No. 2 to Agreement No. A-16558 with Allied Universal Electronic Monitoring US, Inc. for electronic monitoring for Probation clients where the amendment increases the Agreement’s amount by $84,500 for an amount not to exceed $200,000 with no change to the existing term of June 1, 2023 through June 30, 2024; and

b.                     Authorize the Contracts/Purchasing Officer or their designee to execute future amendments to the Agreement where the total amendments do not exceed 15% ($30,000) of the Agreement amount and do not significantly change the scope of services, for a not to exceed maximum amount of $230,000.

 

SUMMARY/DISCUSSION:

The County of Monterey, Probation Department, entered Standard Agreement No. A-16558 (Agreement) with Allied Universal Electronic Monitoring US, Inc. (Contractor) for a term of June 1, 2023 through December 31, 2023 and for an amount not to exceed $105,000 for an electronic monitoring program for the supervision of Probation clients as mandated by the Monterey Superior Court or as part of the probation supervision terms for the various offender populations under probation. The Agreement was subsequently amended through Amendment No. 1 to extend the term through June 30, 2024 and to increase the Agreement’s amount by $10,500 for an updated not to exceed amount of  $115,500.

 

The Probation Department (Probation) has a continued need for services and an increase in funding is necessary to allow the Contractor to continue providing services. Amendment No. 2 has been drafted to increase the Agreement’s not to exceed amount by $84,500 for an updated Agreement amount not to exceed $200,000 and with no change to the existing Agreement term of June 1, 2023 through June 30, 2024.

 

Probation recommends the approval of Amendment No. 2 as it will allow the Contractor to continue providing services vital to the operations of  the Probation Department.

 

OTHER AGENCY INVOLVEMENT:

Amendment No. 2 was approved by the Office of County Counsel as to legal form and by the Auditor-Controller as to fiscal terms. 

 

FINANCING:

The associated funding and appropriations of $200,000 are included in the Probation Department’s FY 23-24 Adopted Budget (PRO001 - Unit 8165). There is no additional cost to the County General Fund with this recommendation.

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

This recommendation supports the Board of Supervisor Strategic Initiatives of Public Safety by supporting Probation’s Electronic Monitoring Program. Probation utilizes electronic monitoring as a probation supervision tool for a number of different offender populations. Electronic monitoring serves as an intermediate sanction/detention alternative, as well as a tool to enhance public safety, by assisting officers in monitoring high risk populations in the community.
