RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.  Adopt Plans and Special Provisions for the Cathedral Oak Road and Pescadero Road Repair Projects; and

b.  Authorize the Resource Management Agency Director to advertise the “Notice to Bidders” in the Monterey County Weekly and El Sol de Salinas.

 

SUMMARY:

Adopting the Plans and Special Provisions and authorizing the Resource Management Agency (RMA) to advertise the Cathedral Oak Road and Pescadero Road Repair Projects (Project), will allow the RMA to proceed with the construction phase of the project and solicit construction bids.  RMA will return to the Board in September to award the project.

 

DISCUSSION:

During the winter storms of 2017 a number of county roads were affected by the heavy rains and excessive storm water flows.  On April 24, 2018, the Board of Supervisors approved a list of 2017 Winter Storm Projects that were obligated for reimbursement.  These repair sites are on that 2017 Winter Storm Projects list, which was presented to the Budget Committee and Capital Improvement Committee prior to Board action.  These two locations of the Project are part of the “Phase 1” list of 51 project locations, approved by the Board at the April 24, 2018 Board Meeting. The purpose of this Project is to repair a damaged section of pavement on Cathedral Oak Road and Pescadero Road.  The Project consists of reconstructing the road bed with new base material and hot mix asphalt.  The construction activities also include providing traffic control around the work zone, and ancillary shoulder grading. 

 

In compliance with the California Environmental Quality Act (CEQA), the Monterey County RMA filed a Notice of Exemption on May 30, 2019. 

 

The bid opening is set for August 15, 2019 at 2:00 p.m., in the Board of Supervisors’ Conference Room 1032, Monterey County Government Center, 168 West Alisal Street, 1st Floor, Salinas, CA 93901.  Project construction is scheduled to begin in October 2019.

 

OTHER AGENCY INVOLVEMENT:

The Office of the County Counsel, Auditor-Controller, and Risk Management have reviewed and approved the Special Provisions as to form and legality, fiscal terms, and insurance provisions respectively. 

 

FINANCING:

When the 2017 Winter Storms were declared a Natural Disaster by President Trump, Monterey County became eligible to receive financial assistance from the California Office of Emergency Services (Cal OES) and Federal Emergency Management Agency (FEMA) to repair damaged infrastructure due to the winter storms.  RMA staff has been working closely with County Office Emergency Services (County EOS) and Cal OES to program funding for eligible Project costs.  Maximum project contributions could be up to 93.75% of the costs incurred, shared by FEMA and the California Office of Emergency Services (Cal OES). 

 

On December 11, 2017 the county received notification that FEMA and Cal OES had awarded $40,266 to the County as the contribution toward the Pescadero Road repairs.  On March 1, 2018 the county received notification that $65,526 had been awarded to the County, by FEMA and Cal OES, toward the Cathedral Oak Road repairs.  To date, these funds have been received totaling in $105,792 in FEMA/Cal OES funds.  

 

The total estimated costs of the two (2) repairs, including environmental, engineering, and construction, is $560,621.   Thus, a total of $105,792 of the project is funded by FEMA/Cal OES grant funds and $454,829 is to be funded by County Measure X funds.  FEMA/Cal OES discounted the project costs to account for ineligible costs due to pre-existing pavement distresses in the area effected by the storms.  FEMA/Cal OES program guidelines do not allow funding repairs needed to address normal wear of the roadway.  These programs focus on funding projects that return the effected infrastructure to its pre-storm conditions, and not for any infrastructure betterment. 

 

The adopted FY 2019-20 Road Fund 002 budget includes sufficient appropriations for these projects, funded with a combination of FEMA funds and local funds.  Attachment A provides a detail cost estimate by repair location.

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

The project will restore the paved surfaces on sections of Cathedral Oak Road and Pescadero Road.  The recommended action supports the following Board of Supervisors’ Strategic Initiative:
