a. Approve and authorize the Director of Health Services or designee to execute an Agreement between the County of Monterey and Andy Phu Nguyen for the provision of Vietnamese interpretation services for behavioral health clients for a total Agreement amount not to exceed $20,000 for a term retroactive to July 1, 2024 through June 30, 2027; and
b. Approve non-standard insurance and indemnification provisions in Agreement as recommended by the Director of Health Services; and
c. Approve and authorize the Director of Health Services or designee to execute up to three (3) future amendments where the combined amendments do not exceed 10% ($2,000) of the original Agreement amount, do not significantly change the scope of services, and do not increase the total not to exceed amount over $22,000.

RECOMMENDATION
It is recommended that the County of Monterey Board of Supervisors:
a. Approve and authorize the Director of Health Services or designee to execute an Agreement between the County of Monterey and Andy Phu Nguyen for the provision of Vietnamese interpretation services for behavioral health clients for a total Agreement amount not to exceed $20,000 for a term retroactive to July 1, 2024 through June 30, 2027; and
b. Approve non-standard insurance and indemnification provisions in Agreement as recommended by the Director of Health Services; and
c. Approve and authorize the Director of Health Services or designee to execute up to three (3) future amendments where the combined amendments do not exceed 10% ($2,000) of the original Agreement amount, do not significantly change the scope of services, and do not increase the total not to exceed amount over $22,000.
SUMMARY/DISCUSSION
The County of Monterey had an agreement with Andy Phu Nguyen which termed on June 30, 2024. This new agreement with Andy Phu Nguyen will continue to provide culturally responsive mental health services in the Monterey County residents’ primary language. The goal and objective are to provide Vietnamese interpretation services for behavioral health clients of the County Behavioral Health Clinic in Marina. County Behavioral Health Bureau (MCBH) staff request his skills to facilitate appointments for residents who qualify for Specialty Mental Health Services provided by MCHB.
This Agreement is retroactive to July 1, 2024, due to contract negotiations due to the non-standard indemnification, limitation of liability, and non-standard insurance provisions.
This work supports the following County of Monterey Health Department 2018-2024 Strategic Plan Goal(s): 3) Ensure access to culturally and linguistically appropriate, customer-friendly, quality health services. It also supports one of the ten essential public health services, specifically: 7) Link people to needed personal health services and assure the provisions of health care when otherwise unavailable.
OTHER AGENCY INVOLVEMENT
County Counsel-Risk Management and Auditor-Controller have reviewed and approved as to legal form and fiscal provisions respectively.
FINANCING
This Agreement is funded by MHSA CSS (100%). The funds for FY 2024-25 are included in the Health Department’s Behavioral Health (HEA012, Unit 8410) FY 2024-25 adopted budget. The funds for FY 2025-27 will be included in the Department’s requested budget for each of the respective Fiscal Year’s.
