Body
RECOMMENDATION:
It is recommended that the Board of Supervisors:
Approve and authorize the Director of Health to sign Renewal and Amendment
No. 1 for FY 2011-12 with Stuart L. Lustig, M.D., M.P.H. for special psychiatric assessment services to Monterey County children residing out of State, extending the term to May 31, 2012 and adding $7,937 for a total Agreement amount not to exceed $18,087.
SUMMARY/DISCUSSION:
Stuart Lustig, M.D., is a specialist who provided psychiatric assessment services for Monterey County children residing out of State under an Agreement with Monterey County Behavioral Health Bureau which expired on December 30, 2011. Dr. Lustig provided assessment services in or around early December 2011 within the contract term of the Agreement but exceeded the total Agreement amount. This Renewal and Amendment No. 1 extends the term to May 31, 2012 and adds $7,937 for a new total agreement amount not to exceed $18,087 to be able to compensate Dr. Lustig for services delivered in December 2011.
The Behavioral Health Bureau was not able to execute an Amendment No.1 prior to the expiration of the original Agreement because County Risk Management did not receive any documentation from the Bureau until after the services had already been provided. Dr. Lustig, who is employed by the University of California, San Francisco (UCSF) provided Monterey County with an insurance certificate for Professional Medical and Hospital Liability which covered the day Dr. Lustig provided the services in Utah. County Risk Management could not approve because the claims made and reported policy was limited to a period of time that expired and was limited to 1 day and had lapsed prior to Risk Management being provided any documents. The Health Department requested that this certificate cover the remaining term of the contract July 1, 2011-December 30, 2011 in the event a claim was filed after the date of services. County Counsel has recommended that this certificate cover the remaining term of the contract July 1, 2011-December 30, 2011 to allow the County to file a claim, if necessary, after the date of services. Unfortunately, UCSF would agree only to provide the insurance certificate for the day(s) that Dr. Lustig in fact provided services.
OTHER AGENCY INVOLVEMENT:
Risk Management reviewed but did not approve this Renewal and Amendment No. 1 as to indemnity and insurance requirements. County Counsel and the Auditor-Controller approved this Renewal and Amendment No. 1 as to legal form and fiscal provisions, respectively. A copy of the Original Professional Services Agreement and the Renewal and Amendment No. 1 is on file with the Clerk to the Board.
FINANCING:
This Agreement totals $18,087 for Fiscal Year 2011-12 and is funded by AB100. There is no General Fund Contribution associated with Amendment No. 1. The appropriations have been included in the Health Department's Behavioral Health Bureau Fiscal Year 2011-12 Adopted Budget.
