b. Authorize the Director of Health Services or designee to sign up to three (3) future amendments to this Agreement where the amendments do not significantly change the scope of work.

RECOMMENDATION:
It is recommended that the County of Monterey Board of Supervisors:
a. Approve and authorize the Director of Health Services or designee to execute Amendment No. 1 to 340B Administrative Services Agreement (“Agreement”) with Wellpartner, LLC., (“Wellpartner”) adding a 340B identifier to Agreement A-14592 for eligible 340B contract pharmacy locations designated by the County of Monterey Health Department Clinic Services Bureau (“Clinic Services”); and
b. Authorize the Director of Health Services or designee to sign up to three (3) future amendments to this Agreement where the amendments do not significantly change the scope of work.
SUMMARY/DISCUSSION:
The Health Department Clinic Services Bureau (Clinic Services) operates twelve community clinic sites designated as Federally Qualified Health Centers (FQHCs), which provide preventative, primary, and specialty medical care services.
Section 340B of the Public Health Services Act mandates that pharmaceutical manufacturers participating in the Medicaid program enter into agreements with Health Resources and Services Administration (HRSA) to provide discounts on covered outpatient drugs to eligible government-supported health care entities.
As a 340B-eligible entity, Clinic Services must enroll each eligible clinic site in the HRSA Office of Pharmacy Affairs (OPA) database to generate unique 340B identifiers for program management purposes.
When Clinic Services transitioned from an FQHC Look-Alike to an FQHC Grantee on September 1, 2019, the unique Look-Alike identifiers for each clinic location were terminated in OPA and those clinics were re-enrolled as FQHC Grantee sites under new 340B identifiers.
Agreement No. A-14592 with Wellpartner, was approved by the Board of Supervisors on January 7, 2020, and while the new 340B identifiers were updated in OPA, Wellpartner’s internal agreement system was not updated. Wellpartner has identified and corrected this gap and now requires that the current 340B Identifiers be added to the contract effective with the Agreement’s original execution date of January 14, 2020. Approval of this Agreement will allow the update to Agreement No. A-14592 and provide transparency to the 340B Identifiers associated with this Agreement.
This work supports the County of Monterey Health Department 2018-2024 Strategic Plan Goals: 1) Empower the community to improve health; and 2) ensure access to culturally and linguistically appropriate, customer-friendly, quality health services. It also supports one or more of the ten essential public health services, specifically: 4) Mobilize community partnerships and action to identify and solve health problems; and 7) link people to needed personal health services and assure the provision of health care when otherwise unavailable.
OTHER AGENCY INVOLVEMENT:
The Office of County Counsel has reviewed and approved Amendment No. 1 as to form.
FINANCING:
Sufficient appropriations are available in the FY 2024-25 Health Department Clinic Services Adopted Budget (4000-HEA007. This Agreement will be funded by revenue generated from Medi-Cal and Medicare. There is no financial impact on the General Fund resulting from approval of this Amendment No. 1.
