Adopt a Resolution approving the amended Conflict of Interest Code of the Monterey Educational Risk Management Authority.

Report

RECOMMENDATION:

It is recommended that the Board of Supervisors, as the code reviewing body, approve the amended Conflict of Interest Code of the Monterey Educational Risk Management Authority.

 

SUMMARY:

 Monterey Educational Risk Management Authority has amended its Conflict of Interest Code, as required by Government Code section 87306.5, to reflect textual changes to the Code. As Code Reviewing Body, the Board of Supervisors must approve this proposal and adopt the Amended Code to render it effective.

 

DISCUSSION:

 Amendments to local agency Conflict of Interest Codes are authorized by Government Code section 87306 of the Government Code whenever changes are required by changed circumstances, by creation or deletion of designated positions, or by changes in the duty of such positions.

 

Pursuant to sections 82011 and 87303 of the Government Code, the Board of Supervisors is the code reviewing body and may approve the Code as submitted, revise the proposed Code and approve it as revised, or return the proposed Code to the agency for revision and resubmission.

 

The Office of the Monterey County Counsel has reviewed and approved the amended Code. The Proposed Amended Conflict of Interest Code of the Monterey Educational Risk Management Authority is lawful under the Political Reform Act of 1974.

 

OTHER AGENCY INVOLVEMENT/COMMITTEE ACTIONS:

 The Office of the County Counsel has reviewed and approved the amended Code as to form.

 

FINANCING:

 The approval of this requested Conflict of Interest Code amendment will have no financial impact upon the County of Monterey.
