Adopt a resolution to:
a. Approve and authorize the Director of Public Works, Facilities and Parks (“PWFP”) to execute a Right of Way Contract, Drainage Easement Deed and Permit to Enter and Construct between the County of Monterey (“County”) and the State of California, Department of Transportation (“State”, or “Caltrans”) for real property located off Highway 68 in the unincorporated area of the County of Monterey, California, for State highway purposes related to the Highway 68 Improvement Project (“Project”); and
b. Approve and authorize the Director of Public Works, Facilities and Parks (“PWFP”) to execute any future Caltrans Right of Way Contracts, Drainage Easement Deeds, Permits to Enter and Construct or other encroachment related documents for County owned real property, subject to the review and approval of the Office of the County Counsel.

RECOMMENDATION:
It is recommended that the Board of Supervisors adopt a resolution:
a. Approve and authorize the Director of Public Works, Facilities and Parks (“PWFP”) to execute a Right of Way Contract, Drainage Easement Deed and Permit to Enter and Construct between the County of Monterey (“County”) and the State of California, Department of Transportation (“State”, or “Caltrans”) for real property located off Highway 68 in the unincorporated area of the County of Monterey, California, for State highway purposes related to the Highway 68 Improvement Project (“Project”); and
b. Approve and authorize the Director of Public Works, Facilities and Parks (“PWFP”) to execute any future Caltrans Right of Way Contracts, Drainage Easement Deeds, Permits to Enter and Construct or other encroachment related documents for County owned real property, subject to the review and approval of the Office of the County Counsel.
SUMMARY/DISCUSSION:
The State of California, Department of Transportation (“State”, or “Caltrans”), is proposing to improve existing drainage infrastructure, provide improved lighting equipment, and install a transportation management system monitoring equipment at various locations along State Highway 68 in Monterey County, as part of the Highway 68 Improvement Project (“Project”). Improvements to 25 drainage culvert systems are proposed, including joint repair and/or complete pipe replacement at specific locations. Some of the proposed improvements require drainage and maintenance access easements and encroachment permits to enter and construct on adjacent County owned real property.
Caltrans is requesting access or easement rights to County owned real property parcels referred to as Assessor’s Parcel Number (APN) 173-011-025 (also known as Caltrans parcel number 12638-1) and Caltrans parcel numbers 12657-1, 12657-2, and 12657-3 (collectively referred to as “Subject Parcels”) located along the Highway 68 corridor. Caltrans dedicated the Subject Parcels to the County, for road, utility and drainage purposes, when the original Highway 68 project was first completed. Caltrans would like to acquire a 481 square foot permanent drainage easement on parcel 12657-1 to access and maintain its drainage improvements in perpetuity. Caltrans would also like to obtain an encroachment permit to enter and construct on parcels 12657-2, 12657-3 and 12638-1 for staging purposes for the duration of the Project. The established amount for just compensation from Caltrans to the County for the permit to enter and construct and permanent drainage easement (the “Easements”) is One Thousand and Five Hundred Dollars ($1,500). The Easements are included as Exhibit A and Exhibit B, to the Right of Way Contract (Attachment B).
Approval and authorization of staff’s recommendation will grant Caltrans the right of access and maintenance for its drainage area on the Subject Parcels owned by the County and allow the Project to move forward located along the Highway 68 corridor. Approval and authorization of staff’s recommendation will also allow the PWFP Director to execute other future Caltrans right of way contracts, drainage easement deeds, permits to enter and construct, or other encroachment related documents for County owned real property, subject to the review and approval of the Office of the County Counsel.
OTHER AGENCY INVOLVEMENT:
The proposed right of way contract, drainage easement deed and permit to enter and construct was produced and drafted by Caltrans for County review and approval. The Office of the County Counsel has reviewed and approved the proposed as to form.
FINANCING:
The Board Report and the proposed Agreement were developed by PWFP staff and funded as part of the fiscal year (FY) 2024-25 PWFP Adopted Budget, General Fund 001, Facilities Appropriation Unit PFP054. The total consideration of $1,500 for the Easements will be deposited into General Fund, Facilities.
