RECOMMENDATION:
It is recommended that the Board of Supervisors:
a.      Authorize a retroactive increase for three (3) Professional Services Agreements (PSA) between the County of Monterey,  one (1) with Dougherty Pump & Drilling, Inc. and two (2) with Star Sanitation Services, each with  multi-year terms of July 1, 2012 through June 30, 2015; and
b.      Authorize the Contracts/Purchasing Officer, or his designee, to accept and execute the Amended PSA's between the County of Monterey and the two service providers without obtaining a competitive bid for Fiscal Year 2014-15.     
 
SUMMARY/DISCUSSION:
Dougherty Pump & Drilling, Inc. is the designated operator for the public drinking water systems at Laguna Seca and Manzanita Parks. They provide technical and regulatory advice and assistance for all the north county parks public drinking water systems and inspection services for the backflow prevention devices department wide.  Due to the extensive nature of wells and pumps throughout the north county parks system, utilizing a vendor with the history and the knowledge of the Monterey County Parks system infrastructure allows the department to address concerns efficiently and effectively.  Thorough knowledge of the parks water systems are critical to keep up the health and safety standards that correspond to visitor use patterns, busy holiday weekends, special events, and operational preparedness.
 
Dougherty's quotes are routinely checked against other local vendors to ensure that they are competitive. All work outside of normal testing and maintenance requires an itemized quote to be reviewed by Parks Department managers and utility specialists.  An increase in the three-year Agreement amount is requested from $95,000 to a total of $250,000 for the same period.
 
Star Sanitation Services provides chemical toilets and sewage pumping under one Agreement and track cleaning and sweeping services under a second Agreement for the Parks Department. The County Health Department requires that all chemical toilets be maintained in a clean and sanitary condition.  Because of the lack of developed infrastructure at Laguna Seca, these toilets are placed throughout the facility for use of the public and the turn workers that support the tracks rental program. Star provides regular facility cleaning in the paddock, waste disposal and litter removal that could impact the safety on the track, on-call assistance for any sewage-related emergency, provides cleaning service staff for restrooms at Laguna Seca during both SCRAMP and County events.  An increase in each of the two (2) separate three-year Agreements is requested from $95,000 to a total of $250,000 for the same period.
 
Due to an internal staff error, the Multi-Year Agreements were used in lieu of the single year Professional Services Agreement, as would be appropriate.  These vendors are anticipated to earn over $100,000 for services rendered throughout the term of three years.  For all practical purposes it is in the best interest of the County to retain the services of both vendors for the duration of the Fiscal Year 2014-15.  It is therefore recommended that the Board of Supervisors approve the retroactive increases to the Agreements with these vendors.
 
OTHER AGENCY INVOLVEMENT:
County Counsel has approved contracts as to form.  The County Purchasing Office approves the current recommendation and the Purchasing Department staff will be working with the Parks Department to initiate Requests for Proposals for both of these services.  
 
FINANCING:
There is no effect to General Fund Contribution as a result of this action.  Appropriations for these critical service delivery needs are budgeted in Fiscal Year 2014-15 Approved Budget for Parks Department 7500, PAR001.
