Title: a. RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.  Approve and authorize the Monterey County Laguna Seca Representative to execute a nonstandard agreement between Eliud Garcia, MD and the County of Monterey for the provision of medical services which include acting as Chief Medical Officer and coordination of medical staffing of the medical clinic during premier racing events at WeatherTech Raceway at Laguna Seca, with a term beginning April 1, 2022 through December 31, 2023, for an amount not to exceed $110,000;

b.  Approve the amended nonstandard addendum and Exhibit “B” as recommended by the Director of Public Works, Facilities, and Parks; and

SUMMARY/DISCUSSION:

Dr. Eliud Garcia, a medical graduate of University of California-San Francisco, is a board-certified emergency medicine physician with over 42 years of practice in Monterey County.  He has proven himself as a valuable asset to the County serving as the Chief Medical Officer at WeatherTech® Raceway at Laguna Seca (WRLS) for more than ten years when the medical center is required to be open during premier events.  Dr. Garcia acts as the Chief Medical Officer, and coordinates all required medical staffing, medical equipment, certifications, and insurance, as necessary. 

 

 

Dr. Garcia communicates with sanctioning doctors and directors and completes event-specific forms of compliance.  Dr. Garcia’s knowledge of the operation is invaluable and ensures that proper medical personnel are on-site, available, and coordinated should an emergency occur on the track during an event.

 

The Addendum attached to the proposed nonstandard agreement (Agreement) deletes the Section 8.0 Indemnification clause in its entirety and replaces it with a nonstandard indemnification clause where the Contractor indemnifies and holds harmless the County and the Laguna Seca Recreation Area (LSRA) Manager, and their officers, agents, and employees against any and all claims based on the performance of the Contractor.

 

Exhibit A-Scope of Services (Exhibit A) in the proposed Agreement includes specific necessary roles and requirements determined by the type and style of racing event being held at WRLS. These include such items as required training seminars and coordination meetings with representatives of sanctioning organizations and their governing bodies.  Exhibit A also details the specific support requirements the County and the LSRA Manager will provide.

 

Exhibit B to the Agreement amends the insurance requirements and ensures that the Contractor is maintaining:  1) a current unrestricted license to practice medicine in the State of California, 2) the Contractor’s Board Certification or eligibility in Emergency Medicine, and 3) an unrestricted Federal Drug Enforcement Administration registration as well as participating in the required continuing education programs for his area of specialization.

 

Staff requests the Board of Supervisors approve and authorize the Monterey County Laguna Seca Representative to execute the nonstandard Agreement and up to three (3) future amendments to the Agreement where the total amendments do not exceed ten percent (10%), or $11,000, of the agreement amount and do not significantly change the scope of work.

 

OTHER AGENCY INVOLVEMENT:

The Office of County Counsel and Auditor-Controller’s Office reviewed and approved the Agreement as to form and fiscal provisions, respectively.  Risk Management reviewed and approved the insurance coverage and limits.

 

FINANCING:

The cost of the contracted services provided by Eliud Garcia, MD is not to exceed $110,000 for the duration of the Agreement.  The Fiscal Year 2021-22 Adopted Budget in Fund 453, Unit 8536, Appropriation Unit CAO046, includes sufficient appropriations for these services. Service costs for Fiscal Years 2022-23 and 2023-24 will be included in the submitted budget and forecast, respectively.
