b. Authorize the Director of Public Works, Facilities and Parks to execute contract change orders where the overall total value of change orders does not exceed 70% of the original contract amount and does not significantly change the scope of work.

RECOMMENDATIONS:
It is recommended that the Board of Supervisors:
a. Authorize an additional contingency of 30%the contract amount or $675,210 for a total contingency of 70% ($1,575,489) with Anderson Pacific Engineering Construction, for the Hartnell Road Bridge at Alisal Creek, County Bridge No. 209, State Bridge No. 44C-110, Project No. 385465, State Project No. EA 05-00020138L_N, Federal Aid Project No. BRLO-5944 (103) to provide funding for approved contract change orders; and
b. Authorize the Director of Public Works, Facilities, and Parks (PWFP) to execute contract change orders where the overall all total value of change orders does not exceed the original contract amount plus approved contingency funding, and do not significantly change the scope of work.
SUMMARY/DISCUSSION:
The Hartnell Road Bridge at Alisal Creek Replacement Project, (County Bridge No. 209, Federal Aid Project No. BRLO-5944 (103), Project No. 385465) consists of removing the existing bridge, constructing a new two-lane bridge on the existing alignment, approach embankment grading, paving, associated improvements on Hartnell Road and realignment of the Alisal Creek. On May 24, 2022, the Board of Supervisors awarded a contract to Anderson Pacific Engineering Construction, Inc. (Contractor) in the amount of $2,250,698 to construct the project. As part of its action, the Board also authorized a contingency, not to exceed 10% of the contract amount or $225,070 to provide funding for approved contract change orders.
Construction began on June 24, 2022, and was expected to be completed by the end of February of 2023. However, beginning on December 12, 2022, and through March 2023, the project site experienced flooding from several high intensity storms that damaged the recently constructed improvements. To minimize further damage to the Project, the County directed the Contractor to stop contract construction activities, and immediately perform emergency repairs.
During the January 31, 2023, meeting, the Board approved staff’s recommendation to fund these emergency repairs by increasing the Project contingency by $225,070 (10% of the original contract amount). The total contingency amount was increased to $450,140 or 20% of the original contract amount.
On June 27, 2023, to complete necessary emergency repairs and address changed site conditions resulting from the flooding, staff requested and the Board approved an additional 20% contingency or $450,140. This increased the contingency to 40% of original contact thus increasing the contract budget $3,150,988.
Construction is complete. To fund the work necessary to complete the project and implement environmental mitigation activities, staff is requesting the Board approve an additional $675,210, equivalent to additional contingency of 30%. The contract change orders for the slope repair during the storms total $1,116,534. The proposed additional contingency amount of $675,210 will cover the additional costs of contract change orders and repairs.

FINANCING:
PWFP staff has secured additional funding from Caltrans. The total project cost, including engineering, environmental, and construction is $6,6,990. The Project is financed by the Federal Highway Administration (FHWA) in the amount of $4,805,851 Toll Credit Fund at $622,649, and Measure X at $1,271,490. The proposed additional 30% contingency will increase the project total to $6,699,990. There are sufficient appropriations in the FY 25 Annual Work Program for Road Fund, Fund 002, PFP004, to fund this increase.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
The project consisted of a new two (2) lane bridge on the existing alignment, associated approach embankment grading and paving, and removal of the existing bridge. The recommended action supports the Board of Supervisors’ (BOS) Strategic Initiatives as indicated below:
