RECOMMENDATION:
It is recommended that the Board of Supervisors adopt the attached resolution to:
a. Adopt the Mitigated Negative Declaration for the New Juvenile Hall Project (Project No. 8811);
b. Adopt a Mitigation Monitoring Reporting Program; and
c. Authorize the Probation Department and Resource Management Agency-Public Works to proceed with the New Juvenile Hall Project located at 1420 Natividad Road in Salinas.
SUMMARY/DISCUSSION:
An Initial Study (IS) and a Mitigated Negative Declaration (MND) has been prepared pursuant to the requirements of the California Environmental Quality Act (CEQA) to assess potential environ-mental impacts of the New Juvenile Hall Project (Project). The analysis determined that there is no substantial evidence that the project, as mitigated, will have a significant effect on the environment and, therefore, a Mitigated Negative Declaration is appropriate. A Notice of Intent to Adopt a MND was filed with the County Clerk and published in the Monterey County Weekly on March 13, 2015. The IS/proposed MND was circulated for public comment from March 13, through April 16, 2015. No comments were received. Today's recommended action is to adopt the MND, approve proceeding with the Project, and adopt a Mitigation Monitoring and Reporting Program for the Project.
The proposed project site is a 9.2-acre parcel located on County property at 1420 Natividad Road in the City of Salinas. The current juvenile hall facility, built in the 1950s, has become function-ally inadequate for a number of reasons, including, but not limited to: 1) it does not meet current Title 24 Code of Regulations; 2) its linear design is antiquated, making it difficult to manage and control offenders; and 3) there is insufficient space for classroom, medical and mental health services, rehabilitative programs, and family visitation. The proposed Project is a campus design that promotes best practices toward rehabilitation through smaller ten-bed housing units, program spaces, and recreation areas and socialization/interaction with other youth.
The Monterey County Planning Commission considered the project as part of the Capital Improvement Program (CIP) and found it to be consistent with the Monterey County General Plan. Pursuant to Government Code section 65402, staff issued a letter of referral to the City of Salinas planning agency on May 4, 2015, for its review of the project for consistency with the City General Plan.
OTHER AGENCY INVOLVEMENT:
The County of Monterey is the Lead Agency for the proposed New Juvenile Hall. The County of Monterey RMA - Public Works (RMA-PW) has circulated the IS and MND through the California State Clearinghouse. Probation and RMA-PW are working jointly with the Board of State and Community Corrections (BSCC) to meet the State-mandated milestones to maintain the conditional award and move forward to the Construction Document phase.
FINANCING:
On January 15, 2013, the Board approved a Five-Year CIP financing plan, which includes this Project. In addition to a $35 Million State grant, the County has contributed $17.792 Million from Fund 404, for a total project cost of $52,792 Million. Anticipated, yet undetermined, increased staffing costs associated with operation of a facility larger than the present one may also impact the General Fund Contribution.
