RECOMMENDATION:
It is recommended that the Board of Supervisors:
a.      Approve a Professional Services Agreement with Denise Duffy & Associates, Inc. to provide environmental documentation, California Environmental Quality Act (CEQA)/National Environmental Quality Act (NEPA), and regulatory permitting for the Carmel River Floodplain Restoration and Environmental Enhancement Project located in the Carmel Area Land Use Plan in the amount not to exceed $256,769, for a term of July 29, 2014 through June 30, 2016; and  
b.      Authorize the Contracts/Purchasing Officer to execute the Professional Services Agreement and future amendments to the Agreement where the amendments do not significantly alter the scope of work or change the approved Agreement amount.
 
SUMMARY/DISCUSSION:
This Professional Services Agreement (PSA) with Denise Duffy & Associates, Inc. will provide for environmental documentation, CEQA/NEPA, and regulatory permitting for the Carmel River Floodplain Restoration and Environmental Enhancement Project in an amount not to exceed $256,769.  The term of this PSA is from July 29, 2014 through June 30, 2016.   
 
OTHER AGENCY INVOLVEMENT:
The following offices have reviewed and approved the PSA as to form and legality and fiscal provisions, respectively:
·      Office of the County Counsel
·      Auditor-Controller's Office
 
Due to late submission of this Board Report, the CAO Budget  and Analysis Division was not provided adequate time to fully review for potential fiscal, organizational, policy or other implication to the County of Monterey.
 
FINANCING:
There is no impact to the General Fund as a result of this action.  The costs associated with this PSA for the Carmel River Floodplain Restoration and Environmental Enhancement Project will be funded through an Agreement between the County of Monterey and the State of California Department of Water Resources to reimburse the incurred costs for services provided for this Project.  Because funding for this PSA was not included in the Fiscal Year 2014 - 2015 Adopted Budget, RMA Staff will return to the Board of Supervisors to request approval of an increase in appropriations and revenue for this Project.
