RECOMMENDATION

It is recommended that the Board of Supervisors:

a. Approve and authorize the Contracts/Purchasing Officer to sign Amendment No. 1 to Agreement A-

11516 with Harmony at Home for the provision of counseling services to elementary school-aged

children who have been exposed to domestic violence. Amendment No. 1 extends the term from

June 30, 2010 to June 30, 2011 and adds $75,000 for a revised total amount not to exceed $150,000;

and

b. Authorize the Contracts/Purchasing Officer to approve future amendments up to ten percent 10%) of

the annual amount, which does not significantly alter the scope of work or result in an increase in net

county contribution.

SUMMARY/DISCUSSION

Harmony at Home HAH) establishes and conducts programs that teach healthy communication within

families to end the cycle of violence and abuse. HAH provides school-based domestic violence

counseling services to elementary school-aged children in the Alisal and Salinas Unified Elementary

School Districts, which have been determined to have the highest need and service disparities. These

services address the emotional trauma and related issues of children who have witnessed and/or

experienced violence. The program is included in Monterey County's Mental Health Services Act

Prevention and Early Intervention Plan.

This Amendment No. 1 will assure continuation of the program for one additional fiscal year for a

revised maximum total Agreement amount of $150,000 for the period August 1, 2009 through June 30,

2011.

This Agreement contains the County's standard 30-day no cause" provision Section IV, D), which

provides the County the ability to amend or terminate the Agreement in the event of a reduction and/or

termination of funding. Should the funding be reduced or terminated, Behavioral Health Bureau will

implement a plan to terminate this Agreement as needed.

OTHER AGENCY INVOLVEMENT

The County Counsel, Auditor-Controller and Risk Management have reviewed this Amendment No. 1

and concur. The Amendment is on file with the Clerk of the Board.

the Health Department's Behavioral Health HEA002) Unit 8073 Fiscal Year 2010-11 Adopted Budget.

Approval of this action has no impact to the Net County Contribution. This Amendment No. 1 is brought

before the Board for approval with the understanding that realignment funding has been proposed for reduction

in the State's Budget May Revise. Should the funding be reduced or terminated, Behavioral Health will

implement a plan to transition consumers receiving services as required and/or terminate this Agreement as

needed.

AMENDMENT No. 1 TO AGREEMENT A-11516

This Amendment No. 1 to Agreement A-11516 is made and entered into by and between

the County of Monterey, hereinafter referred to as COUNTY, and Harmony at Home,

hereinafter referred to as CONTRACTOR.

This Amendment No. 1 modifies the Mental Health Services Agreement as specified

below.

1. Amend Section IV TERM AND TERMINATION, Paragraph A, Term, to read as

follows: This Agreement shall be effective August 1, 2009 and shall remain in effect until June

30, 2011.

2. EXHIBIT A-1 replaces EXHIBIT A. All references in the Agreement to EXHIBIT A

shall be construed to refer to EXHIBIT A-1.

3. EXHIBIT B-1 replaces EXHIBIT B. All references in the Agreement to EXHIBIT B

shall be construed to refer to EXHIBIT B-1.

4. EXHIBIT H-1 replaces EXHIBIT H. All references in the Agreement to EXHIBIT H

II. POPULATION OF FOCUS

Monterey County Elementary and Middle school-aged children who suffer from trauma

and related issues due to exposure to domestic and other violence.

III. PROGRAM DESCRIPTION

A. The Prevention and Early Intervention PEI) Component of Mental Health Services

Act MHSA) funds prevention and early intervention programs in Monterey County.

Under PEI guidelines, funded programs must be geared to serve the priority

populations as defined by the State Department of Mental Health, which are included

in Monterey County's approved PEI Plan as follows:

 Un-served and Underserved Cultural Populations

 Trauma Exposed Individuals

 Children and Youth at Risk of Juvenile Justice Involvement

 Children and Youth in Stressed Families

B. The School-Based Domestic Violence Counseling Program shall address the

emotional trauma and related issues of children who have witnessed violence. This

PEI program shall be delivered by the CONTRACTOR working in a non-traditional

mental health setting to reduce the stigma that children may otherwise face as a result

of having to endure the effects having been a witness of violence. Psychosocial

educational counseling or brief therapy in a group setting or individual basis will be

provided to help prevent the development of serious emotional disturbance in the

future.

C Harmony At Home HAH) Sticks & Stones School-Based Counseling Program is a

prevention program for children exposed to violence and trauma in Monterey County.

HAH's mission is to establish and conduct programs that teach healthy

communication within families and end the cycle of violence and abuse in families.

IV. SCOPE OF WORK

A CONTRACTOR shall provide domestic violence counseling services on school

grounds and at an offsite location as it is deemed necessary, to address the

emotional trauma and related issues of children who have witnessed violence.

B CONTRACTOR shall work with parents/caregivers initially to obtain their

authorization to serve their child and will also provide parents/caregivers with

tools to help create a home environment that will foster a child's healthy

psychological and emotional development.

C CONTRACTOR shall meet with parents/caregivers to assess and refer them to

conflict resolution skills in the provision of mental health services to trauma-

exposed children and their parents/caregivers.

D CONTRACTOR shall address domestic violence issues from the perspective of

trauma-exposed children who are living in stressed families and are at risk of

school failure or juvenile justice involvement.

E CONTRACTOR shall develop partnerships with Monterey County elementary

schools, Monterey County Behavioral Health Division, local community based

organizations and develop a referral system.

F CONTRACTOR shall identify additional program resources that can be

leveraged, such as in-kind contributions.

G CONTRACTOR shall participate in planning for sustainability of the program in

collaboration with key Behavioral Health staff and the PEI Coordinator.

H CONTRACTOR shall assure services are planned, provided and evaluated using

practices that demonstrate the core values of the Mental Health Services Act, i.e.

Districts based on highest need, service disparities and student demographics

determining that the students to be served are members of an underserved cultural

population. Underserved cultural populations is defined by the Department of

Mental Health as  those who are unlikely to seek help from any traditional

mental health service either because of stigma, lack of knowledge, or other

barriers such as members of ethnically/racially diverse communities, members of

gay, lesbian, bisexual, transgender communities, etc., that seek non-traditional

mental health services).

K CONTRACTOR shall provide the Alisal and Salinas Unified Elementary School

Districts with the following:

 Three 3) ten 10) week School-based Domestic Violence Counseling

program series over a thirty-four 34) week term. In each ten 10) week

counseling program series a minimum of four 4) children shall be served.

 The fourth program series consists of the Parent Education and Family

Support services over the eleven 11) month contract term.

L CONTRACTOR shall assign a licensed clinician or qualified intern/trainee to

each of the elementary schools being served.

M CONTRACTOR shall provide assessments determining the service needs of each

referral, and provide referrals to other services as needed.

N CONTRACTOR shall establish a support group for students based on teacher or

parent referral at each of the elementary schools being served.

V. PROGRAM GOALS

A To reduce stigma regarding domestic violence, mental illness and those who

access mental health services

B To improve child and family functioning

C To assess psychosocial needs and provision of brief early intervention counseling

on an individual and/or family basis

D To promote parent involvement in meeting their child's academic, social and

psychological needs

E To provide community resource information and referrals for children and

families requiring additional mental health. services

F To prevent the future development of serious emotional disturbance and/or

serious mental illness

EXHIBIT B-1:

PRIOR AUTHORIZATION AND PAYMENT PROVISIONS

1. PAYMENT TYPE

Negotiated contract amount.

II. PAYMENT CONDITIONS

A In order to receive any payment under this Agreement, CONTRACTOR

shall submit reports and claims in such form as may be required by the

County of Monterey, Department of Health, Behavioral Health Division.

Specifically, CONTRACTOR shall submit its claims on a form acceptable

to COUNTY so as to reach the Behavioral Health Division no later than

the 30th day of the month following the month of service. Upon

termination of this Agreement, CONTRACTOR shall submit its final

claim for payment no later than thirty 30) days after the completion of

services.

B If CONTRACTOR fails to submit claims for services provided under the

term of this Agreement as described above, the COUNTY may, at its sole

discretion, deny payment for that month of service and disallow the claim.

C COUNTY shall review and certify CONTRACTOR's claim either in the

requested amount or in such other amount as COUNTY approves in

conformity with this Agreement, and shall then submit such certified

claim to the COUNTY Auditor. The County Auditor-Controller shall pay

the amount certified within thirty 30) days of receiving the certified

invoice.

D If COUNTY certifies payment at a lesser amount than the amount

requested COUNTY shall immediately notify the CONTRACTOR in

writing of such certification and shall specify the reason for it. If the

CONTRACTOR desires to contest the certification, the CONTRACTOR

must submit a written notice of protest to the COUNTY within twenty

20) days after the CONTRACTOR's receipt of the COUNTY notice. The

parties shall thereafter promptly meet to review the dispute and resolve it

on a mutually acceptable basis. No court action may be taken on such a

dispute until the parties have met and attempted to resolve the dispute in
