RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.  Approve Standard Agreement with the following two (2) contractors: Environmental Logistics, Inc., and Advanced Chemical Transport, Inc., to provide hazardous waste management services to include removal, transportation, and disposal of waste materials, on-call and emergency response spill cleanup from various County locations pursuant to RFP #10722, Environmental Logistics, Inc. amount not to exceed $450,000 and Advanced Chemical Transport, Inc. amount not to exceed $300,000 for a combined total of $750,000, for a term of three (3) years beginning May 1, 2021 to April 30, 2024, with the option to extend each Agreement for up to two (2) additional years; and

b.  Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to execute the Standard Agreements and future amendments to the Agreements where the amendments do not increase the approved Agreement amount.

 

SUMMARY:

The recommended actions would allow for the approval of a Standard Agreement (SA) with Environmental Logistics, Inc., in the amount of $450,000 (Attachment A) and Advanced Chemical Transport, Inc., in the amount of $300,000 (Attachment B) to provide hazardous waste management services, including removal, transportation, and disposal of waste materials, and on-call and emergency response spill cleanup from various County locations.

 

DISCUSSION:

County of Monterey Department of Public Works, Facilities, & Parks (PWFP) - Roads and Bridges Maintenance Division is responsible for emergency response and removal of waste materials due to spills and/or dumping on County roads and rights-of-way.  PWFP also handles parks, lakes, and open space, as well as storage and disposal of self-generated materials at County facilities. PWFP is also responsible for emergency response to dumping and/or spills, including water-borne spills at Lake Nacimiento in San Luis Obispo County. The County Administrative Office (CAO) Fleet Maintenance Management Division is responsible for hazardous waste management at County refueling facilities which includes underground and aboveground storage tanks.  Storage of waste materials is restricted to a maximum of ninety (90) calendar days by the County’s Hazardous Materials Management Services (HMMS) a division of Environmental Health Bureau.  HMMS is designated as the local Certified Unified Program Agency (CUPA) in Monterey County and is responsible for inspecting facilities in the County to verify proper storage, handling and disposal of hazardous materials and hazardous waste. Hazardous materials must be removed by a licensed contractor in compliance with all local, State, and Federal laws.

 

On October 15, 2020 the County issued Request for Proposals (RFP) #10722 to solicit proposals from qualified contractors for hazardous waste management services, including removal and hauling of hazardous waste oils, paints and other hazardous/universal/biohazard waste materials from various County locations, drum management, and on-call and emergency response spill cleanup.  The County received two (2) responsive proposals.  Environmental Logistics, Inc (ELI) and Advanced Chemical Transport, Inc. (ACT) submitted proposals which demonstrate their capacity to abide by all local, state, and federal regulations and to provide all labor, materials, tools, equipment, and supervision necessary to provide hazardous waste management services solicited through RFP #10722.  Following staff’s review and evaluation of the proposals, both bidders were selected for award based on their qualifications.  ELI was selected as the primary contractor for scheduled pickup of self-generated waste and on-call and emergency response spill cleanup; ACT was selected to provide additional support for on-call and emergency response spill cleanup as needed as well as standby service for scheduled pickup of self-generated waste. This standby service is inactive at the start of this contract but may be activated by PWFP at a future date as needed.  Both bidders have the expertise and capabilities necessary to provide the services solicited through RFP #10722, in accordance with County policies and State laws.

 

Approval of the recommended action will allow for the issuance of two (2) SAs for hazardous waste management services, one with ELI in an amount not to exceed $450,000 and the second with ACT in an amount not to exceed $300,000, for a combined total of $750,000, each for a period of three (3) years beginning May 1, 2021 to April 30, 2024, with the option to extend each SA for two (2) additional years.  The not to exceed amounts for each contract reflect the different scopes of work for ELI and ACT as primary and backup service providers.

 

OTHER AGENCY INVOLVEMENT:

The Office of the County Counsel-Risk Manager and Auditor-Controller’s Office have reviewed and approved the SA as to form and fiscal provisions, respectively.

 

FINANCING:

Costs associated with on-call hazardous waste management services and funding will be contained within the approved budget allocations of the individual departments authorizing the use of these on-call SAs.  For PWFP, funding is either within the approved budget allocations for a specific operating unit within Road Fund Unit 8443, Appropriation RMA012, Litter Control Unit 8194, Appropriation RMA002, or Parks Unit 8510, Appropriation RMA104.  While actual expenditures will depend on quality and type of materials tested, picked up and disposed of, the budgeted amounts are projected to be sufficient to cover expenditures.

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

The recommended action supports the Board of Supervisors Strategic Initiatives for Health & Human Services and Public Safety and enables PWFP to complete essential services related to hazardous waste removal and disposal.
