RECOMMENDATION:
It is recommended that the Board of Supervisors:
Approve and authorize the County to accept assignment of the Right-of-Ways (ROW), CACA-048028 & CACA-048028-01 transfer from the Sports Car Racing Association of Monterey Peninsula (SCRAMP) permitting existing storm water dispersion outlet onto Bureau of Land Management (BLM) property.
 
SUMMARY/DISCUSSION:
Eight years ago SCRAMP obtained a Right-of-Way from BLM permitting water run-off from Turn 6 of the Laguna Seca racetrack to drain onto BLM land immediately adjacent to the track.
On March 15, 2012, BLM performed a site inspection on SCRAMP right-of- way #CACA 048028 for an existing storm water dispersion outlet. It was BLM's determination that SCRAMP had failed to comply with the terms of their grant; citing several violations of the Right-of-Way Stipulations. A Notice of Non-compliance identifying the violations was sent to both SCRAMP and the County on January 7, 2013. In accordance with 43 Code of Federal Regulations (CFR 2807.17(a), BLM may suspend or terminate the grant if applicable laws and regulations or any terms, conditions, or stipulations are not met.
BLM has requested that the County assume the Right-of-Way in order to ensure a proper drainage system. The County Parks Department is also interested in an effective drainage system for Turn 6, and also wishes to maintain collegial relations with BLM due to extensive inter-agency cooperation in this and other matters.  For these reasons staff recommends accepting assignment of the Right-of-Way.
 
OTHER AGENCY INVOLVEMENT:
The Monterey County Parks Department has stepped in to address the drainage problem and has been working with BLM staff to mitigate the problem. The Parks Department, in coordination with the Resource Management Agency and Contracts/Purchasing, released Request For Proposal #10486 on April 24, 2014 seeking qualified professionals to develop a detailed geological investigation and geotechnical engineering design alternatives for the lower sloped area adjacent to and below turn 6 of the racetrack at Laguna Seca Recreation Area.
 
FINANCING:
The funds for implementing an effective drainage system below Turn 6 will come from designated track fund monies.  There is no adverse effect to General Fund Contribution as a result of this request.
