Approve Amendment No. 1 to Standard Agreement No. A-15223, Multi-Year Agreement #3200*5661, with Environmental Logistics, Inc. to provide hazardous waste management services, Request for Proposals #10722, to update the Pricing Schedule effective May 1, 2024, extend the expiration date for 2 additional years through April 30, 2026, for a revised term of May 1, 2021 to April 30, 2026, and increase the not to exceed maximum by $270,000 to a total of $720,000; and
b. Authorize the Contracts & Purchasing Officer or their designee to execute Amendment No. 1 to Standard Agreement No. A-15223 and future amendments to the Agreement where the amendments do not significantly alter the scope of work or increase the approved Agreement amount.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve Amendment No. 1 to Standard Agreement No. A-15223, Multi-Year Agreement #3200*5661, with Environmental Logistics, Inc. to provide hazardous waste management services, Request for Proposals #10722, to update the Pricing Schedule effective May 1, 2024, extend the expiration date for 2 additional years through April 30, 2026, for a revised term of May 1, 2021 to April 30, 2026, and increase the not to exceed maximum by $270,000 to a total of $720,000; and

SUMMARY/DISCUSSION:
County of Monterey Department of Public Works, Facilities and Parks (PWFP) requires hazardous waste management services. PWFP Roads and Bridges Maintenance is responsible for emergency response and removal of waste materials due to spills and/or dumping within County Road rights-of-way. PWFP Parks Division utilizes these services for storage and disposal of self-generated materials at County facilities. PWFP Parks is also responsible for emergency response to dumping and/or spills, including water-borne spills at Lake Nacimiento in San Luis Obispo County. PWFP Fleet is responsible for hazardous waste management at County vehicle maintenance and refueling facilities including underground and above ground storage tanks. Storage of waste materials is restricted to a maximum of 90 calendar days by the County’s Hazardous Materials Management Services (HMMS), a division of the Environmental Health Bureau. HMMS is designated as the local Certified Unified Program Agency (CUPA) in the County of Monterey and is responsible for inspecting facilities in the County to verify proper storage, handling and disposal of hazardous materials and hazardous waste. Hazardous materials must be removed by a licensed contractor in compliance with all local, State, and Federal laws.
In February 2021, Environmental Logistics, Inc., and Advanced Chemical Transport, Inc., were selected for their expertise and capabilities necessary to provide hazardous waste management services, including removal and hauling of hazardous waste oils, paints and other hazardous/universal/biohazard waste materials from various County locations, drum management, and on-call and emergency response spill cleanup, and to provide Department of Transportation approved containers for storage and disposal under a competitive selection process in accordance with County policies and State and Federal laws, as set forth under Request for Proposals (RFP) #10722.
On May 11, 2021, the Board of Supervisors approved SA No. A-15223 with Environmental Logistics, Inc. in the amount of $450,000 to provide hazardous waste management services for a term through April 30, 2024, with the option to extend the Agreement for up to 2 additional years.
PWFP staff recommends that the Monterey County Board of Supervisors approve the proposed Amendment No. 1 (Attachment A) to the SA with Environmental Logistics, Inc. to continue to provide hazardous waste management services to the County. Amendment No. 1 will update the provisions of the SA, update the Pricing Schedule effective May 1, 2024, extend the expiration date for 2 additional years through April 30, 2026, for a revised term of May 1, 2021 to April 30, 2026, and increase the not to exceed maximum by $270,000 to a total of $720,000.

OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel and the Auditor-Controller’s Office have reviewed and approved Amendment No. 1 as to form, and fiscal provisions, respectively.
FINANCING:
Costs associated with hazardous waste management services and funding will be contained within the approved budget allocations of the individual departments authorizing the use of these SAs. For PWFP, funding is either within the approved budget allocations for a specific operating unit within Public Works, Facilities and Parks. Actual expenditures depend on quality and type of materials tested, picked up and disposed of, and the projected budgeted amounts are sufficient to cover expenditures.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
The recommended action supports the Board of Supervisors’ Strategic Initiatives for Health & Human Services and Public Safety. These essential services enable PWFP to manage hazardous waste removal and disposal and to remain compliant with all local, State, and Federal laws.
