Adopt a Resolution authorizing a third two-year extension of the Memorandum of Understanding by and among the County of Monterey, El Sur Ranch and Don Smythe regarding the role and services of a reserve Deputy Sheriff, retroactive to January 1, 2017.

RECOMMENDATION:

It is recommended that the Board of Supervisors:

Approve a resolution authorizing a third two-year extension of the Memorandum of Understanding by and among the County of Monterey, El Sur Ranch and Don Smythe regarding the role and services of a reserve Deputy Sheriff, retroactive to January 1, 2017.

 

SUMMARY/DISCUSSION:

On December 13, 2011, the Board approved an MOU with El Sur Ranch to provide a Reserve Deputy to assist in providing services to the Big Sur area.  The original term of the MOU was for one year.  The Reserve Deputy, Don Smythe, began providing services in February of 2012.  A copy of the MOU is enclosed as Attachment A.  In December of 2012 the Board authorized a two-year extension of the MOU.  A copy of that extension is enclosed as Attachment B.  In December of 2014 the Board authorized a second two-year extension, through January 5, 2017.  A copy of that extension is enclosed as Attachment C.

 

The Sheriff’s Office continues to believe the program is working as intended and has provided a significant resource to the County.  This resource has been provided at very little cost (training of the Reserve Deputy) to the County and has saved the County directly by eliminating the need for a Deputy to drive to certain calls, and saved the County indirectly by reducing the liability associated with having the Reserve Deputy as a backup in potentially dangerous situations.  For these reasons, the Sheriff’ Office would like to extend the current MOU for an additional two years so that the County may continue to benefit from the services of Reserve Deputy Smythe.  A proposed Amendment No. 3 to the MOU is enclosed as Attachment D.  A draft resolution authorizing the Sheriff to execute the Amendment No. 3 is enclosed as Attachment E.  In any event, the MOU may be terminated for any reason by either party upon 24 hour notice.

 

The second extension was through January 5, 2017, thus this approval is necessarily retroactive.  In order to avoid the expiration of this extension during a time when the Board is on recess, it is recommended that the extension be through January 31, 2019.

 

OTHER AGENCY INVOLVEMENT:

County Counsel has approved the amendment as to form.

 

FINANCING:

Required annual training for the Reserve Deputy will be provided by the Sheriff’s Office through its annual budget.  There are no additional costs to the County for the services provided under this MOU.
