Approve Amendment No. 1 to Professional Services Agreement No. A-15826, Multi-Year Agreement #3200*6415, with Biggs Cardosa Associates, Inc. to continue to provide construction management services for the Hartnell Road Bridge Replacement Project, Request for Proposals #10804, to increase the not to exceed amount by $287,146 for a total amount not to exceed $680,474 with no extension to the term from June 15, 2022 to June 14, 2025, with the option to extend the term for two (2) additional one (1) year period(s); and
b. Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to execute Amendment No. 1 to Professional Services Agreement No. A-15826 and future amendments to the Agreement where the amendments do not significantly alter the scope of work or increase the approved Agreement amount.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve Amendment No. 1 to Professional Services Agreement No. A-15826, Multi-Year Agreement #3200*6415, with Biggs Cardosa Associates, Inc. to continue to provide construction management services for the Hartnell Road Bridge Replacement Project, Request for Proposals #10804, to increase the not to exceed amount by $287,146 for a total amount not to exceed $680,474 with no extension to the term from June 15, 2022 to June 14, 2025, with the option to extend the term for two (2) additional one (1) year period(s); and
b. SUMMARY/DISCUSSION:
The County of Monterey, Department of Public Works, Facilities and Parks (PWFP) proposes to replace the existing two (2)-lane Hartnell Road Bridge (County Bridge No. 209) over Alisal Creek in Monterey County, California, with a wider bridge, Hartnell Road Bridge Replacement (Project), that meets current American Association of State Highway and Transportation Officials (AASHTO) requirements. The proposed Project would also widen the roadway approaches for approximately 370 to 470 feet on the north and south ends of the bridge to conform to the replacement bridge width and profile. After construction, both the bridge and roadway approaches would contain two (2) 12-foot lanes with one (1) in each direction and two (2) 8-foot shoulders and meet current AASHTO minimum speed standards.
Biggs Cardosa Associates, Inc. (BCA) was selected for their expertise and capabilities necessary to provide construction management services for the Project under a competitive selection process in accordance with County policies and State and Federal laws under Request for Proposals (RFP) #10804. On June 7, 2022, the Board of Supervisors approved Professional Services Agreement (PSA) No. A-15826 with BCA in the amount of $393,328 to provide construction management services for the Project for a term through June 14, 2025.
The recent 2023 winter storms limited the seasonal window of time to complete construction activities and due to the damage caused by the storms, a second season of construction will be necessary to allow for additional services for repair of the Project. PWFP staff recommends that the Monterey County Board of Supervisors approve Amendment No. 1 (Attachment A) to the PSA with BCA to continue to allow construction management services for the Project. Amendment No. 1 will increase the not to exceed amount of $393,328 by $287,146 for a total amount not to exceed $680,474 with no extension to the term ending on June 14, 2025.
Attachments A, B, C, D and E, provided for reference, include proposed Amendment No. 1, PSA No. A-15826, the Project Budget, the Project location map, and a summary of the PSA and its annual expenditures and balance to date.
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel and the Auditor-Controller’s Office have reviewed and approved Amendment No. 1 as to form, and fiscal provisions, respectively.
FINANCING:
The total estimated cost of the Project including design engineering, environmental, right-of-way, and construction is $5,025,076. The original project budget for the Project was $4,701,586.
The Project is largely funded by the Federal Highway Administration (FHWA) Highway Bridge
Replacement Program in the amount of $4,175,131. The Federal funds require an 11.47% local match that will be provided by State Toll Credits fund in the amount of $512,243. Local Measure X funds in the amount of $337,702 will also be provided. See Attachment C for further details on the Project budget. There are sufficient appropriations in the adopted fiscal year (FY) 2022-23 Road Fund 002, Appropriation Unit PFP004 budget to finance Amendment No. 1 for the construction phase of the Project.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
The recommended action supports the Board of Supervisors’ Strategic Initiatives for Infrastructure and Public Safety. The Project consists of replacing an existing bridge that is structurally deficient and functionally obsolete with a bridge that meets current geometric and seismic standards.
