RECOMMENDATION:

It is recommended that the Board of Supervisors approve and authorize the County Purchasing Agent or designee to execute Amendment No. 1 to the Agreement between the County of Monterey and A & B Fire Protection and Safety, Inc., MYA 8955, to retroactively change the term date to start from December 22, 2025 to July 1, 2025 and update insurance provisions, with no increase to the not to exceed amount or contract term.

 

SUMMARY

Public Works, Facilities and Parks (PWFP) manages the Service Agreement with A & B Fire Protection and Safety, Inc. (A & B Fire) for annual inspections and testing and on-call maintenance service and repairs for fire sprinkler suppression systems for County owned buildings and facilities. The current Agreement has a term date of December 22, 2025 to December 21, 2028, and there is a need to amend the term of the Agreement to begin on July 1, 2025 to pay for services provided by A& B Fire prior to December 22, 2025, and to update the insurance provisions to meet current requirements.

 

DISCUSSION:

PWFP recommends approving and authorizing the Contracts and Purchasing Agent or designee to execute Amendment No. 1 which retroactively changes the term of the Agreement to begin on July 1, 2025 to allow payment of invoices for July and October 2025 quarterly inspections and testing and which updates the insurance provisions to meet current requirements.

 

 

The State of California requires quarterly inspections and testing of County’s fire sprinkler suppression systems for County owned buildings and facilities. A & B Fire has provided these services for the County under a series of agreements. The current agreement was negotiated last year as the previous agreement expired in December 2025.  The County received two invoices for services that were provided while the previous agreement was still active, but which exceeded the not to exceed amount of the previous agreement.  It was anticipated that these two invoices would be paid under the new agreement.  However, the term of the new agreement which provided for a December 22, 2025 to December 1, 2028 term, did not include this invoiced service period.  The new (current) Agreement term needs to be revised to begin on July 1, 2025 to allow for payment of  invoices for services provided by A & B Fire in July and October 2025.

 

OTHER AGENCY INVOLVEMENT:

The Office of the County Counsel-Risk Management and Auditor-Controller’s Office have reviewed and approved Amendment No. 1 as to form, insurance and fiscal provisions, respectively.

 

FINANCING:

There is no minimum guaranteed work under this Agreement.  Funding for individual work orders is verified within the approved budget allocations prior to commencement of work.  For PWFP, funding is held within the approved budget allocations for General Fund, 1001 Facility Services Appropriation Unit PFP101.
